| Show AN ACT further defining the duties of the officers of tig penitentiary andhor and for jor other purposes sec see 1 be ne it enacted by the governor and legislative assembly At of th he territory of utah that the warden ot of the penitentiary Is amby authorized and required to ad advertise vertise in the consecutive numbers ot some newspaper published in great salt lake late county tor for sealed proposals for logg the penitentiary for not less than one than three years jears the sald bald advertisement shall shail set forth the place 4 dy y and hour that the proposals shall be opened and that the penitentiary warden house and other buildings connect there therewith irith or belonging to the penitentiary will be let in consideration of which the lessor will for a certain bum sum take the care and custody of all convicts that are now or may be committed to bald said penitentiary daring during the term terra ol 01 contract and that the lessee legee may appoint tha the guards overseers and other officers that may nay ba be necessary to keep safely arely and securely rely and to carry out the sentence of the convicts pay the guards overseers and other officers and assistants by him employed he lie shill shall direct and control the labor of the convicts and have the avalis avails thereof in addition to the bum sam set forth in the proposition or article of agreement kli all proposals shall be made under seal aad and endor endors rail seil proposals for tor or leasing the penitentiary addressed to the warden wardin on or before the day set act forth lo 10 the advertise ad vertle merit men on which day and not becore they shall be opened by the warden in the presence of the directors AIL all the bidders who may choose to be present and the warden atter alter reading all the proposals propos Ais als in the presence 0 of the directors ald and the bidder bidders shall submit the several bids to the directors the said directors may thereupon determine which Is the best responsible bidder provided the bidder Is la a resident citizen of the territory and of a reputed good moral character and will dle die sufficient suc sum clent booda with them thela for the faithful per forman e of the conditions editions dit ions lons of the contract then they they the y shall direct the tha warden to accept such guch bid and file papers accordingly provided it moy be at the tha discretion of th dire tors to accept or decline any iny or all the ridsy it in their judg ment mint 06 bids are for a greater amount than thin Is reason reabon able to give in which cabe case they may proceed as though the tha first erst section of this act hai had not been parsed or they may mat at any other time thereafter kt IA the penitentiary bia tia provided in this act sec 2 the person whose whosel bid ld may be accepted and fale file binds bonds and take possession of the premises and tenements as c contemplated in this act ls is Is 14 hereby constituted an assistant warden and as such shall file sufficient clent bonds with security with directors payable to the people of the territory of staby urah utah for the faithful perform performance anco of or his duties as asi assistant stant warden provided he shall not bave bava any claims for services as such assistant warden tn in tha event that the penitentiary and convicts are not rented as contemplated in this act the warden may hire out any kny or kii kil the a is under such guch regulations as may roy moy be prescribed by the directors provided such regulations ions do not conflict with the laws of this territory all convicts convict i hereafter sentenced excepting inch as may be sentenced tol toi soll Bull tarr tarT confinement may be put to hard bard labor not exceeding tep ten hours each day dayt except excepted el under the tha tria are or may way herek beret I 1 ter be prescribed by the directors a 1 approved january 15 y 2 |
