The proposed amendment to section 2 provides that all tangible property not exempt shall be taxed hi proportion to its value but does not require but permits the taxation of intangible property The proposed amendment to section 3 provides that shall provide by law a uniform and equal rate of assessment and taxation of all tangible property in this state according to its value in monevery person and corey in proporporation shall pay ofa tax his her or its tion to the value tangible property But what as to intangible property? It provides that “intangible property may be exempted from taxation as property or it may be taxed in such manner and to such extent as the legislature may provide” Now observe if you please that th language I have quoted does not say that intangible property shall be taxed as property or in such other manner as the legislature may provide but that it may be exempt from taxation as property or may be taxed in some other manner There is nothing requiring the taxation of intangible property in any way The taxation or exemption from taxation iz left entirely to the will of the legislatureas But it is provided that if taxed the-legislat- so-th- -- f '' '' A" r " learning hair! This is a strange way of equalizing taxes Moreover if the legislature should exempt intangible property from taxation as property which it may do if these amendments are adopted and should provide some other method of taxing such property it may be taxed in such manner and to such extent as the legislature may provide Now why should the legislature be given such unlimited power in the taxation of intangible property while all tangible property must be taxed at its money value? And wrhy provide that each owner of tangible property shall pay taxes in proportion to the value of his property while the owner of intangible property is required to pay only such rate as the legislature may provide? Since the legislature which these amendments thought proper to limit the rate of taxation on intangible property for the next six years to 5 mills on the dollar while the owners of tangible property may be required to pay seven or eight times that rate may we not assume that future legislatures will continue this discrimination after -- HE t: W AGEE Brazil Takes Tariff Lightly RIO DE JANEIRO— (UP)-- The A committeemen refused his request By that time he was determined not to run He carried his case to the New York supreme court but the five judges of the appellate division at Rochester ruled that state laws contained no provisions allowing a candidate to decline a nomination after August 23 The judges sympathized with Jerge’s request but held they could not grant it f-- t a-f- lut pre-o-lan- tic -- OGDEN’S STADIUM — Brazilian Shave Same As Serve-Se- lf RIO DE JANEIRO— (UP)— Getting a shave in a Brazilian barber shop is an experience only duplicated in few other places of the world In the first place one sits upright in a chair Then there is no taking off of coats There is no hot water used unless requested Finally the victim washes his own face TWO NEW DO-X’- S BERLIN — The airplane that startled and surprised the world the Domier DO-- X is to have two sister ships if information received through aviation circles proves correct It is company reported that the Dornier is at work building two new planes the size of the DO-- X and that they are expected to-b- e completed in May 1931 - Represents municipal building progress at low cost employing Utah labor and utilizing Utah material this year As the contractors who built this structure we invite the visiting municipal officials to inspect the Ogden municipal stadium We will also he pleased to present to those interested authoritative data on present building costs o Hotel isrelow Welcomes the STATE MUNICIPAL LEAGUE F DINSMORE & GO Bra- zil refuses to take the new Cuban tariff increases seriously despite the fact these tariffs impose double duty on all coffee imports The general view both in government circles and among coffee growers and exports is that Imports of Brazilian coffee into Cuba mounted to only 14951 bags or 106 per cent of the total exports of this country The volume and Tatio are considered to be so insignificant that Brazil need not consider Cuba’s coffee tariff seriously but that at tention should be turned to German French and Italian tariffs consid ered here more of a menace - Democrat Running Didn’t Want Job BUFFALO N Y— (UP)— At least one candidate in the Impending New York general elections does not want the office he is seeking Henry F Jerge Democratic nominee for congress in the 41st district is the candidate Jerge was selected while he was in Europe and on his return notified the committeemen 31 November 1 In Convention October David Eccles Building Ogden Utah -- J proposed January 1 1937? The advocates of these amendments frankly admit tnat the object of their adoption is to avoid the rule of uniformity required by the present constitution and the laws enacted in accordance therewith so that intangible property may be taxed at a lower rate than is imposed on tangible property Now why should the farmer who owns a farm valued at $5000! be taxed at the rate of 36 mills while the owner of intangible property of the same value can be taxed only 5 mills on the dollar? But it is said that under the present constitution and laws intangible property escapes taxation If this is so the fault lies not with the constitution or the law but with the administration of the law Under the existing provisions of the law every person and corporatom may be required by the assessor to disclose what if any intangible property such person or corporation owns But while ostensibly the pur pose of these amendments is to compel the owners of intangible property to bear their proportion of the burdens of taxation the real purpose is to avoid the rule of conformity which requires every per son and corporation to pay a tax in proportion to the value of his her or its property tangible and intangible This as I have said is frankly admitted by the advocates of these amendments This rule of uniformity lies at the very foundation of any just system of taxation It requires each person and corporation to contribute according to his or it3 ability to pay and to the protection afforded by the law Whenever we depart from this fundamental principle of justice and equity we are on dangerous ground :A that he wished to decline i HEADQUARTERS AT HOTEL BIGELOW 4 " i w 0- 350 BATHS 350 ROOMS COFFEE SHOP — DINING ROOM POPULAR PRICES ° MUMCIPA — ’ I FIREPROOF GARAGE IN CONNECTION t A HOTEL BIGELOW r x The Utah Idaho Central Railroad Company acknowledging the fine it has received from the municipalities within its territory extends a welcome to the men and women of the Municipal League who are meeting in Ogden and offers them whatever service it may render to make their convention a delightful event OGDEN UTAH- - A co-operati- on Business in Your Town Will Be Better 1 V - of your citizens will take advantage of the favorable conditions in' 1930 and authorize needed public im- provements Transportation problems are solved when systems- between cities and towns provide adequate service —with ample equipment handled by competent employes properly directed with understanding management That is the kind of service that this company is endeavoring to provide for the cities and towns— and surrounding rural areas — of northern Utah and southeastern 'Idaho inter-communicati- ng i - You buy practically all public on the deferred im-proveme- nts pay-me- nt plan— hut you get the benefit of them now create employment for your workmen and get the ad- vantage of low costs Think it over — and start some-ca- n help thnigi Perhaps we are invited Your you inquiries PORTLAND CEMENT ASSOCIATION 506 IlcCornick Building Bait Lake City Utah -- o- UTAH AlLROAD CO A Rational Organization to Improve and Extend the Uses of Concrete S General Offices Ogden Utah o PORTLAND CEMENT CONCRETE PE FOR R II A N E IT C E |
