According to a unanimous decision on BeBee's appeal, the court held Judge Hougaard in prejudicial error for failing to sustain the defense attorneys objection to closing remarks of the prosecuting Attorney to the jury. The defense had objected to the prosecutor's reference to BeBee as an "accomplished fence," but the judge ruled that the statement was not evidence and that the prosecutor had a right to make such deduction as he thought was reasonable from the evidence.
