manufacture sale bartering giving away or otherwise furnishing of intoxicating liquors etc without my iny approval there is in this tit mt some ubron provision that I 1 have pointed out as being in fit s senate bill no 69 an ali act providing for police and fire departments lit in cities of this state of and more inhabitants etc that Is there is bathis let act a class of municipal corporations created for special purple without re reference ferene to the existing ch classification assifi cation by general law I 1 refer to tife ali e provision of the act which provides pio vides for election in counties ani and in subdivisions thereof and lit in cities containing more than inhabitants to determine dete whether or not the sale or manufacture of intoxicating liquors shall be prohibited hibi ted the class mentioned lit in tile the let act and in ili these provisions is one of the classes already created by general law diw it is a 1 clacks by tile the let act self itself it and for the purpose of the act such a special classification is in my opinion unconstitutional that ill at being liue flue it would result in leaving 1 a I portion of the state that would woula not come within the local opt option on provis tons lons of this act that is lit in cities containing moe mo e than inhabitants there could not be held elections to determine whether or ilot hot intoxicating liquors honors should be sold or manufactured ind and that being the case the law would not operate uniformly and for that reason beahon all that portion of this act wherein it is provided for such election must necessarily fall and it further appears to me upon illon the reading of tills this act that these provisions providing for the elections as I 1 have already set out are so 0 o connected and intermingled intermingle with the other provisions of the act which provide tor for the regulation of the sale of I 1 intoxicating liquors that it if the portion which I 1 have pointed out as being unconstitutional must fall the whole act itself would necessarily be vitiated further in fit my opinion under the existing laws the local authorities have power to prohibit pio hibit the sale of liquor and where licenses licen ces have been granted to revoke such licenses at it any time thue when the law ind and conditions connected with the grf ot of suck licenses ire are not complied with
