SSS BEITORDAINED BY THE CITY COUNCIL OF PRICE CITY, U X AH NOTICE OF HEARING Notice is hereby given that the Carbon County Board of Adjustment will hold a public hearing on June 1, 1977, at 7:30 P.M. in the Commissioners Room of the Court House, Price, Utah for the purpose of considering a zoning variance by Clifford L. & Shannon Axelsen on property located mile east of office and warehouse, Price, Utah. Details of the proposed variance is to allow a home to be built on a lot smaller than zoning permits at present. By order of the Board of approximately AdjustmenV SECTION I. Purpose of Regulation. The purpose of this adIPt.a code reatin8 to food service sanitation of Price Municipal Corporation, Carbon County, Stci?rTmiian4 provide a method of administering the same. Adoption of Food Service Sanitation Code. That certain code establishing regulations for the control of conditions in food service establishments, entitled Codesanitary of Food Service Sanitation Regulations, Part I, II and III, adopted by the Utah State Board of Health, July 16, 1969, and published by the Utah State Board of Health as a code in book form is hereby apand adopted as the Code of Food Service Sanitation proved Regulations of Southeastern Utah Health District, Utah, and by reference made a part of this regulation to the same effect and extent as though said Code were copied herein in full, and Three copies of such Code shall repealing Ordinance No. 1228-7be filed with the City Recorder. SECTION III. "Local Health Officer Redefined. Section A, relating to the definition of terms is amended to redefine Local Health Officer as the health officer designated by the governing body of the Southeastern Utah Health District or his authorized representative, or the Medical Director of the Price City Health e Department at such time that a Department is established by the City. SECTION IV. Business License. No person shall operate any food service establishment or a food or beverage vending machine within Price City limits without first applying for and receiving an approved business license. Business licenses for food service are issued by the Price City Council and will be reviewed quarterly before renewal. Before the Council will approve or renew a business license appliction, the applicant must show evidence of a valid permit to operate issued by the local health office. Licenses may be issued on a conditional basis as determined by the City Council. Operation permits issued by the health office are not transferable from one person to another person or place. The permit and business license shall be posted in every establishment. The Health Officers Permit to Operate and the business license are renewed concurrently each quarter. All demerits items of 6 point value must be corrected before a renewal will be issued. SECTION V. Health Department Notification. Before any new food service establishment or an existing establishment under new ownership begins service to the public, the owner, operator or new manager shall notify the local health department having jurisdiction of the planned operation and shall arrange for an inspection of the food service facility to determine compliance with Part II of the Code of Food Service Sanitation Regulations. SECTION VI. Inspection. The Health Officer shall perform the function of food service establishment inspection necessary for the enforcement of this Ordinance, and shall for this purpose be permitted to enter, at any reasonable time, any food service establishment within Price City for the purpose of making inspections to determine compliance with this Ordinance. SECTION VII. Issuance of Notices. Whenever the health authority makes an inspection of a food service establishment and discovers that any of the requirements of Section B through G of Part II of the Code of Food Service Sanitation Regulations have been violated, he shall notify the permit holder or operator of such violations by means of an inspection report form or other written notice. In such notification, the health authority shall: 1. Set forth th$ specific violations found together with the demerit score of the establishment and he may also: 2. Establish a specific and reasonable period of time for the correction of the violations found in accordance with the following provisions: a. when the demerit score of the establishment is 20 or less, all violations of 4 demerit points are to be corrected by the time of the rear,13 full-tim- next routine inspection; or b. when the demerit score of the establishment is more than 20 but not more than 40, all items of 4 demerit points shall be corrected within a period of time not to exceed 30 days; or c. when one or more 6 demerit point items are in violation, regardless of demerit score, such items must be corrected within a period of time not to exceed 10 days ; or d. when the demerit socre of the establishment is more than business license. 40, the City Council may issue a conditional Said license will set forth specific steps needed to receive unconditional approval and time period allowed; or e. when the demerit score of the establishment is more than 40 clean-uorder shall be on two successive inspections, a issued. Failure to comply with any notice issued in accordance with the provisions of this ordinance may result in immediate suspension of the permit. 4. An opportunity for appeal from any notice or inspection findings will be provided if a written request for a hearing is filed with the local health officer within the period of time established in the notice for correction. Notices provided for under this section shall be deemed to have been properly served when the original of the inspection report form or other notice has been delivered personally to the permit holder or person in charge or such notice has been sent by registered or certified mail, return receipt requested, to the address of the permit holder. A copy of such notice shall be filed with the records of the local health authority. SECTION VIII. Plan Review. When a food service establishment is hereafter constructed or extensively remodeled, or when an existing structure is converted for use as a food service establishment, properly prepared plans and specifications for such construction, remodeling or alteration, showing layout, arrangement and construction materials of work area, and the location, size and type of fixed equipment and facilities, shall be submitted to the Health Officer for approval. This approval shall be based upon specifications and standards outlined in Code of and must be received Food Service Sanitation Regulations before such work is begun. SECTION IX. Extraterritorial Jurisdiction. Food from food service establishments outside the jurisdiction of the Health Officer may be sold within the Southeastern Utah Health District if such food service establishments conform to the provisions of this ordinance or to substantially equivalent provisions.
