Claiming thnt he is a victim of mistaken identity, Martin has waged a hard fight since his imprisonment to secure his release. Before Martin's arrest in Nevada on the murder charge, liayter O. Philion, Canadian Mar veteran, was tried in the Carbon court for the slaying of Pappacostas but was able to refute the charges, later receiving $5000 from the state in compensation for the false arrest. Two others convicted from Carbon county were granted terminations of sentence. Mike Fragadakis, who was convicted In the Carbon court on a charge of voluntary manslaughter, was granted termination of sentence, as was Chris Averitt, who was sentenced from this county for grand larceny. Fragadakis served four years, and has been on parole 3 years and 12 days, while Averitt served one year and has been on parole for two years nine months and 23 days. The cases of two other Carbon prisoners, Lee Diamenti, convicted of assault with intent to murder, and Frank Devenish, who was found guilty of a statutory crime, were continued.
