It has been brought to my attention by several juveniles and adults that some business houses In Salina have cigarette vending machines that are accessible to minors. Utah Laws, Section states as follows: Any person who maintains after June '30, 1941, in his place of business a tobacco vending ma18 chine accessible to minors or provides any method of self-he- lp for disposition to minors by gift, sale or otherwise of any cigarette , cigarette paper, or tobacco in any form, Is guilty of a misdemeanor. It is not necessary that juveniles actually get caught purchasing cigarettes from such a machine, but the mere fact that the machine is there where they can get to it is sufficient for prosecution. If any juvenile does purchase any cigarettes from such a machine, the proprietor as well as the employee on duty are subject to prosecution for contributing to the delinquency oi a juvenile. The penalty for either violation is a fine up to $300.00 and imprisonment in the county jail up to six months or either fine or imprisonment. This court. If further complaints are received to the effect that juveniles are receiving tobacco from such machines will Insist on prosecution of any person guilty of the offense. The offense does not require that the clerk or proprietor know that a juvenile has made such purchase. Sterling R. Bossard, Judge Fourth Dist. Juvenile Court 1he Old limw.
