Show ' ORDINANCE NUMBER 195 - ' AN ORDINANCE providing for the holding of & special election in Brigham City, Utah, for the purpose of subnuttng to the qualified taxpaying electors thereof the question of the issuance Water of $2,000,000.00 and Electric Revenue Bonds and $500,000.00 Water Bonds of said city. WHEREAS Brigham City desires to improve and extend its waterworks plant and system and electric plant and system; and WHEREAS said city does not have on hand money to pay the cost of such improvements and extensions, but the revenues to be derived by the city from the operation of its waterworks plant and system and electric plant and system will not be pledged or hypothecated n any manner or for any purpose at the time of the issuance of the bonds herein proposed to be authorized, except that 25.64 of the net revenues of the electric plant and system of said city have been pledged to the payment of certain Electric Bonds dated April 1, 1952 originally issued in the amount of $100,000 and now outstanding in the amount of $30,000, and to pay part of such cost the city desires to issue its Water and Electric Revenue Bonds in the amount of $2,000,000.00 payable from such revenues in the manner for which provision is hereinafter made under the provisions of Chapter 3 of Title 55 of the Utah Code, 1953, as amended; and WHEREAS in addition to the issuance of said Water and Electric Revenue Bonds, the City Council has determned to provide for defraying part of the cost of improving and extending the waterworks plant and system of said city through the issuance of general obligation bonds of said city to the amount of $500,000.00; and WHEREAS it is desired to submit the question of the issuance of such bonds to the vote of the qualified tax paying electors of the city; NOW,, THEREFORE, Be It and It Is Hereby Ordained by the City Council of Brigham City, Box Elder County, Utah as follows; SECTION 1. That on the 26th day of May, 1959, there shall be held a spa;ial election between the hours of 7:00 oclock A. M. and 8:00 o'clock P. M. at which there shall be submitted to such qualified electors of said city as shall have paid a property tax in the year preceding such election the propositions appearing in the form of ballot set out in Section 5 hereof. SECTION 2. That the voting places for said election and the officials to serve at each voting place shall be those specified in the form of notice of election set out in Section 4 hereof. SECTION 3. That the registration agents for the several election districts of said city shall, between the hours of eight oclock A. M. and nine oclock P. M. on the first and third Tuesdays immediately preceding said election, receive and register the names of all persons applying for registration who are legally qualified and entitled to vote at such election or who will legally have acquired a residence (being otherwise qualified), and who will have a right to vote at said election according to the provisions of the law under which said election is to be held, and each registration agent shall give notice of registration required by the general election laws, including Section of the Utah Code Annotated, 1953. SECTION 4. That notice of said election shall be given by publishing the following notice of election once a week for not less than four consecutive weeks in the Box Elder Journal, a newspaper of general circulation published in Brigham City, the first publication to be at least 28 days prior to said election and such notice shall be further given by the posting by the registration agent of each regularly established election district in at least five conspicuous places within his district at least five days prior to the date fixed for said election, that is, on or before the 20th day of May, 1959; ! That immediately after its adoption this ordinance shall be signed by the Mayor and City Recorder, shall be recorded in a book kept for that purpose and shall be published in the Box Elder Journal, a newspaper of general circulation published in Brigham City, Utah, aud qualified to carry legal notices under the laws of the State of Utah.
