The action came Monday after a preliminary hearing for Stanley Reed Palmer, 49, 36 West Fifth North, Tremonton. He had been charged in connection with a fatal accident that occurred Oct. 19, nine miles west of Tremonton. Palmer was driving one of two pickup trucks involved. The charge was dismissed when the court determined that the state failed to show the defendant was under the influence of intoxicants. A public defender plan was scuttled this past week when Cache county officials rejected the arrangement. It would have employed Brigham City attorney Dale M. Dorius as defense counsel for all criminal indigent cases in Box Elder, Cache and Rich counties. Members of the Box Elder commission signed the agreement Monday, as did Dorius, and sent it to neighboring Cache county for approval. However, a letter from Clerk Iver L. Larsen Thursday said Cache officials had turned thumbs down. "The problem has been thoroughly discussed with the Cache County Bar association and it is the conclusion of the county commissioners that we proceed through the year 1971 as we did in 1970 using our local attorneys in all indigent cases," Larsen wrote. Bound Over In other recent city court action, Valden Kotter, 18, 119 East First South, was bound over to First District court on a charge of robbery. He was arrested Dec. 17 in connection with a robbery at a gas station west of Brigham City Dec. 16 at 9 p.m. A station attendant told Box Elder county sheriffs deputies that a thief entered the station, pulled a gun on him and demanded Money. Bail was continued at $5,000 cash by city Judge Robert Daines. Grand Larceny Charge Three Thursday were bound over to district court on charges of grand larceny in connection with an alleged car theft from Oregon. Stanley Fornari, 20, Springfield, Pa., David Swanson, 23, Portland, Ore.; and Eugene Harry Ritchie, 29, Bloomington, Calif., were arrested Dec. 22 at a Tremonton cafe by Tremonton police. Man Satisfactory After Knifing incident BE A Perry man remained in satisfactory condition Saturday after being stabbed in the neck early Thursday morning on the slopes east of Hargus hill in North Willard. Doyle Chamberlain, 20, was reported in intensive care this weekend by a McKay hospital authority. Billy J. Brown, 41, also of Perry, was charged with assault with a deadly weapon after Box Elder Sheriffs Deputy Stanley May signed a complaint before City Judge Robert Daines Thursday. A preliminary hearing was set in Brigham City court Jan. 19 at 11 a.m., for Brown during an arraignment Thursday afternoon. A request for preliminary hearing came after the court appointed Jack Molgard as attorney for Brown. Bail was set at $2,500 cash or $5,000 property by Judge Daines. Brown was released from the county jail Thursday night. Sheriff Warren W. Hyde said Chamberlain and Brown met at a farm in Perry between 10 and 11 p.m. Wednesday night and decided to go for a ride. However, it appeared not to have the same appeal for Cache county where Larsen reportedly said that expenses there to defend indigents never has exceeded $500 a year. By contrast, this past year Box Elder paid out $2,934.35 to two local attorneys appointed by the court in indigent cases. These included Dorius, $1,653.10, and Jack Molgard, $1,281.25. The Box Elder Board of Education has approved a policy in accordance with federal standards which will make the lunches available in cases of financial hardship to students in the district. Superintendent J.C. Haws said a letter of explanation on the program accompanied by an application blank will be sent home to all parents in the district during the week of Jan. 4. The car driven by a Richmond woman, cut across the highway and forced the Nance vehicle off the eastside of the highway, he said. Trooper Naylor said the Nance vehicle slid on ice on the shoulder of the highway into a utility pole in Ervin H. Jensens Husky Service station. The investigating officer said the 1965 Nance vehicle was totally demolished. The Richmond driver was cited for failure to yield the right of way, he said.
