CENSE, TAX, REGULATE OR PROHIBIT THE KEEPING OF DOGS. BE IT ORDAINED BY THE OF THE CITY OF BRIGHAM, COUNTY OF BOX ELDER, STATE OF UTAH; CITY COUNCIL Section 5 Collection of Dog License Fees The City Recorder shall col. lect all dog license fees. Section Dogs to be regls. tered and Licensed; It shall be unlawful for any person to own or keep a dog which Is over six months of agq within the corporate limits of the City without making ap. plication to the City Recorder for a dog license. The fee and 9 ' penalties for such license to be established by resolution from time to time by the City Council, which shall be payable to the City Recorder. The 11. cense fee shall be due and pay. able beginning with the first day of January of each year and shall be delinquent If not paid on or before the first day of March and shall expire on the thirty first day of December of the year In which license Is secured. After March first, all delinquent license fees shall be charged a Two Dollar, ($2.00), late charge except that all dogs brought Into the City shall be given a grace period of thirty days for the purchase of the license at the normal establish, ed fee. All dogs brought Into the City In any year after March first shall be charged the orlgi. nal, rate of license if purchased within thirty days from arrival, the license shall otherwise be considered delinquent. Replacement dog tags shall be Issued upon payment of One Dollar ($1.00), for each tag so Issued to replace any original tag which has been Inst or de. stroyed, upon filing an affidavit of loss or destruction by the person who secured said original tag. Each application for dog license shall be accompanied by a certificate signed by a 11. censed veterinarian which shall state the date on which such dog was Immunized tor rabies, and that the expiration date of effectiveness of such lmmuni. zatlon will be effective for the entire period for which the 11. cense Is Issued. Section 4.37' Collars with Dog Tags to be worn Each dog registered and 11. censed as provided In Section shall wear a suitable col. lar with a dog tag attached thereto as assigned and Issued by Brigham City for said dog. Section 4.38 Impounding Dogs without Collars and Dog Tags Any dog over six months of age within the corporate limits of Brigham City that Is not wearing a collar with dog tag attached thereto as provided In Is here, and Section by declared to be a nuisance and shall be Immediately taken and impounded. Any dog so lm pounded and not claimed by Its owner or keeper within 72 hours shall be sold or humanely kill, ed as directed by the Brigham City Board of Health and City Council. Such period of Impound, ment shall be exclusive of official city holidays and Saturdays and Sundays. The Animal Con. trol Officer shall make a rea. sonable effort to determine the ownership of the dog so lm. pounded and send written notice of Impoundment to the known owners and owners of record. Female Dog In Heat. Section The owners or keepers of a female dog shall cause such dog, when In season, to be penned or enclosed In such a man. ner as to preclude other dogs from attacking such female dog, or being attracted to such le. male dog so as to create a public nuisance. It shall be unlawful for the owner or person having possession, charge, custody or con. trol of any female dog to cause, permit or negligently allow the same to stray or run, or In any other manner to be at large In or upon the streets or sidewalks while such female dog Is In the copulating season, & such te male dog shall be deemed a nuisance and Impounded, by the Department of Animal Control. Such female dog may be claim, ed by Its owner .or keeper as set out In Section 4. 48, and the Animal Control Officer shall made a reasonable effort to determine the ownership of the dog so Impounded and send writ' ten notice of Impoundment to 6 8 7 9 the owners. Section 4.40 Permitting Dog In Place of Worship It shall be unlawfull for any owner or possessor of a dog, except a Seeing Eye Dog, to allow or permit the same to in any place of enter or worship during public service. It shall be unlawful for any owner or possessor of a fierce, dangerous, or mischievous dog to permit the same to run at large, or permit It to run loose on or within the premises of any person or persons In such a manner as to endanger the narsnn tow. It shall be unlawful for any person to kill or cause to be killed any registered or licensed dog without the certified writ ten consent of the owner or except thereof, possessor as herein otherwise provided, or to deprive a registered or licensed dog of Its dog tag, or to put a dog tag on any dog not registered or licensed. Section Barking or Howling Dogs It shall be unlawful for any person to own, keep or harbor within the limits of the City any dogs which by barking, howling or yelping disturbs the peace and quiet of any neighborhood or person. Section 4.44 Leash Required on Street, etc. It shall be unlawful for any owner or keeper of a dog to allow such dog to be on any public street, sidewalk, or pub. 11c place within the City unless such dog Is on leasji, unless otherwise specifically allowed by pertinent sanitation codes and ordinances. Section 4.45 On Private Proper, ty Without Consent. It shall be unlawful for any owner or keeper of a dog to allow such dog to run upon any private property within the City without the consent of the owner or tenant In possession of such property. n the enforcement of any of this ordlance any police officer or the supervisor of the Department of Animal Control or his deputies are authorized to go upon the yards and lands of any person to take possession of a licensed or unlicensed, fierce, dangerous, or vicious dog when In fresh pursuit of such dog at the time the dog goes on to private property. Section Impounding and Re. claiming Dogs running at Large (a) All dogs, whether licensed or not, found running at large within the corporate limits of the City shall be taken up and Impounded for a period of not to exceed seventy two (72) hours as set out In Section 4.38. Any dog so Impounded and not claim-eby Its owner or keeper with. In seventy two hours (72) shall be sold or humanely killed by the Animal Control Officer or his alternate as directed by the Brigham City Board of Health and City Council. (b) The owner or keeper of any dog so Impounded may reclaim the dog within the period of Impoundment by paying to the City a fee In the amount 'of Five Dollars, ($5.00) for the first day of Impoundment or any portion thereof, and a fee of one dollar ($1.00), per day for each day thereafter or any part thereof. (c) If any dog Impounded as herein provided was not wearing a collar and dog tag at the time it was Impounded, It shall not be released to the owner or keeper thereof, until the owner or keeper has, In addition to paying the Impounding fee, eith. er purchased a dog tag as pro. vided for by City ordinance or produced the registration, dog tag, or official receipt for the payment of the current years In pro-visio- 6 d registration of the dog. (e) All Impounded dogs not redeemed by the owner or keep, er within seventy two (72) hours may be sold for no more or no less than Seven Dollars ($7.00) for males and spayed and Ten Dollars females, ($10.00) for unspayed females, at either public or private sale. Before any such dog Is releas. to such buyer, said ed dog shall be vaccinated for ra. bies at the buyers expense. Sale price of the dog to Include dog tags. (f) It shall be unlawful for any person to harbor or keep within the City of Brigham any lost or strayed dog. Whenever any dog shall be found which appears to be lost or strayed it shall be the duty of the finder to notify the Department of Animal Control which shall Impound said dog and dispose of the same as herein provided for the disposition of a dog Impounded or running at large contrary to the terms of this ordinance. Elaine Sheffield, president of the BEtte Club, reciprocated by telling the Intermountain school students what the requirements are to belong to the BEtte club, and told of some of the activities In which the club has participated during the current school year. The BEttes sang their club songs to complete the program. Following the meeting, the Intermountain girls served fry bread, a traditional Navajo food, and punch to their guests.
