Ham ilton, Brigham City and Clearfield druggist, was revoked last Friday and he was sentenced to serve out the two years remaining of an income tax conviction when he appeared before U. S. District Judge Willis W. Ritter. Revocation was made, the judge contended, because Hamilton who owns a 51 percent partnership in the Clearfield Pharmacy, was in part responsible for dispensing certain drugs without prescriptions. Glade R. Day, minority partner in the firm and Leslie B. Otte, pharmacist at the store, plead guilty on May 2 to the illegal drug sales at Clearfield and were sentenced by the court on June 7 at which time1 Judge Ritter fined the pharmacy $6,000, gave Day a $5,000 r sentence on fine and the drug count which he sus-- , pended in favor of revoking his probation on the income tax conviction. Otte was given a r sentence. probation The fine against Day was suspended last Friday. Hamilton, through his counsel, denied all John S. Boyden, knowledge of the Clearfield stores illegal drug sales. He claimed that he had pleaded guilty to the tax charges mainly to protect his junior partner. He contended none of the deficiency was from the Brigham City operations. Dr. Harper L. Pearse appeared as a character witness to tell the court that in his business with the Hamilton pharmacy, since 1949, Hamilton had been and honest and bore a good reputation in Box Elder county. one-yea- Janeen John and Alan Craig By water won the fancy of the judges at the Fourth of July celebration held at Rees Pioneer park on July 5.
