The complaint was filed on May 17 and ivill be made twenty days, after that date. In the meanwhile the contractors, Knowlton & Rupert, are proceeding with the excavation and are getting building material on the ground as rapidly as possible. The situation is to be deplored. No one can fprecast the outcome. The commissioners feel that they are right, and are proceeding with determination. The opposing group feels they are right and are carry- ing the matter into the courts,. If the courts decide that the commissioners are proto ceeding according to law, the opposing group will have abide by the decision and the courthouse will be built If the court decides that the commissioners, clerk, treasurer and contractors are not proceeding according to law, they will be held personally responsible for the money expended to the people of Davis county. The above, we hold, is a fair statement of the situation as it now stands. This being true, it would be the P&rt of wisdom on the part of the county commissioners, officials, and contractors to cease building operations until the matter . is ajudicated in the courts. There should be no personal feeling in this jnatter, lor in the last resort the whole matter must be decided by the courts. All the officials are under bond; and, if the court finds held personally they have proceeded illegally, they can be also their monies; of public responsible for all expenditure bondsmen. court It' will be a matter of only a few days before the make to will decide the case, and It seems the grossest foUy a bad situation worse by proceeding with the building. It It matters not who is to favor of the proposition. not matters not who is against the proposition. It matters are how many meetings are held or: how many, petitions courts circulated. The matter is now in the courts. Theto abide wiU have wiU have the last say, and both parties ' . by the decision of the courts. comWe take it that no one wants to make the county spent missioners personaUy responsible for the moneyassociated those and the building; and that is what they, found they are not Iwith them, will be asked to do if it is ' acting within the law. .Now is the time reason let to prevail.
