Show THE PAGE SIX " ORDINANCE THE CREATION CONFIRMING AN ORDINANCE OF PAVING DISTRICT AND ESTABLISHMENT NO. 2, IN THE" CITY OF LOGAN; PROUD IN G FOR THE PAYMENT BY INSTALLMENTS OF THE IMPROVEMENTS i COST AND EXPENSES OF THE ASSESSING THE MADE IN SAID DISTRICT; COST OF SAID DIPROVEMENTS AGAINST THE REAL ESTATE ESPECIALLY BENEFITED BY SAID IMPROVEMENTS LYING AND BEING WITHIN THE DISTRICT AND FOR THE BENEFIT OF WHICH SAID TAXES ARE TO BE EXPENDED; PROVIDING ACCEPTING THE IMPROVEMENTS FOR THE PAY'MENT OF THE COST OF CONSTRUCTION BY THE ISSUANCE OF COUPON WARRANTS. WHEREAS, the City Commissioner of the City of Logan, in the County of Cache, and State of Utah, haa heretofore, pursuant to the requisite preliminary proceedings, resolution duly adopted and notice of intention duly given and published, established and created Paving District No. 2, in said City, and provided for the construction of concrete pavement, curbs and gutters, and parking, therein; and, WHEREAS, the City Commissioners of said city, pursuant to such notice of Intention, considered and heard written objections to such improvements, but such written objections to such Improvements signed of the front feet abutby the owners of thereof to be Imor streets the portions ting upon Recorder of said filed with the not were City proved law, city at the time and in the manner required byJuris-, and the said city Commissioners has acquired diction to construct and cause to be constructed concrete pavement, curbs and gutters and parking in such paving district and to levy and assess a special tax or assessment against the property especially benefited by such improvement; and the cost of such improvement has been ascertained by contract, duly let to the lowest responsible bidder, after due publication of a notice calling for bids for the construe and . tion of such improvement; WHEREAS,, said improvement has been conducted and completed, strictly in accordance ' with the terms of the said contract, in front of and along the property hereinafter described, and the value of the work, labor and material done and furnished has been duly certified by the engineer to be, and it is hereby found and determined that the cost of such improvement so constructed and completed is $23,219.14 - dollars, and WHEREAS, the Mayor and City Commissioners of said city desire to issue coupon warrants in payment of the cost and. expense of said local improvement heretofore incurred, such warrants to be issued and drawn against the fund created by the payment of the special tax levy or assessment hereby made, levied and assessed. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSIONERS OF LOGAN CITY, UTAH: Section, 1. That said improvement constructed and completed in front of and along the property hereinafter described be and it is hereby accepted by the said City of Logan, and that the cost thereof be and hereby is found and determined to be $23,219.14. Section 2, That the cost and expense of said lm provement, consisting of concrete pavement, curbs and gutters, and parking, in front of and along the property hereinafter described within said Paving District No. 2, which property is hereby found anti determined to be especially benefited by the said improvement to the extent and in the dimensions hereinafter described, shall be paid for in installments consisting of ten equal installments, payable as provided by law; the first installment becoming due the 7th day of January, 1915, being , Fifty days from the date on which this levy becomes effective by confirmation as hereafter provided; the second installment becoming due and payable on the 17th day of November, A. D., 1915, being one year from the date on which this levy becomes effective as - two-thir- ds , .
