An appalling naval disaster with enormous loss of life occurred at daylight today when the battleship Liberte blew up in this harbor. The death loss is variously estimated from 350 up to 500 or more. The killed include officers and men of the Liberte anTStso a large number of those from nearby warships. The first alarm of fire was sounded shortly after 5 oclock a. m. This was followed by four successive explosions of increasing, intensity as the fire neared the powder magazines, when at 5:35 a deafening explosion literally tore the great warship to pieces and sent her to the bottom a mass of twisted wreckage. The force of the explosion was o were great that huge fissures -- peared. The Democrate lost dead and 50 injured. The Liberte was anchored in the roadstead, where she has been since the review of the fleet by President Fallieres on Sept. 4. INITIATIVE U. Washington, Sept. 25. If subsequent. information bears out the first advices as to the extent of the loss of life on the Libfcrte, the disaster, will go down in history as one of the greatest i naval annals, the loss of more than 250 lives on the American battleship MaineFeb. 15, 1898, standing second in the mortality lLt. Based on the first reports of the terrible naval, disaster in Touloh harbor. theexperts of the navy department here were disposed to believe that the explosion on the Liberte resulted from spontaneous ignition of some of the smokeless powder which had deteriorated from , having been kept too long without inspection. It is to guard against just such accidents that Uited States naval regulations require a eareful examination of the powder in- - the magazines of warships short intervals. This examination involves a ghemical test ealeulated to demonstrate absolutely the safety of the powder. U S. .Supreme Court Will Bender Decision as to Their 26. The . Washington, Sept. initiative and referendum - probably will he the 'subject of a decision with ,far reaching consequences by the supreme eourt of the United States during the approaching term. The question of the constitutionality of these expedients of government forms the basis of a Suit' between the state of Oregon and the Pacific States Telephone & Telegraph company. A the case is near the head of the docket, it will be reached in time to insure a decision before the end of the term. The case originated in the companys challenge of a law enacted by the Oregon legislature under the initiative plan, by which a tax of 2 per cent was placed on the gross earnings of telegraph and telephone companits. Taking the position that the initiative and referendum, which are coupled in the Oregon law, are inconsistent with the. republican form of government, guaranteed by the Constitution of the United States the company refused for four years to pay the assessments. The state thereupon brought suit. There was a hard fought battle in the triallcourt, hut the decision was .favorable to thj law. A like conclusion was reached by the supreme court of the state, and the company, still unsatisfied, earried !the case to tbe highest tribunal on a writ of error.
