Wilson to recover something like $90C He alleges in his complaint that he and Wilson formed by the terms of which Wilson furnished a sawmill and Miles was to run it and the profits divided. lie says that Wilson represented to him that he owned certain lands upon which Miles cut timber, when as a matter of fact the lands belonged to the government and he was stopped from cutting and made to pay for what he had already cut. He also alleges that he paid out various sums for Wilson and has never received them' back. lie asks that Wilson be compelled to repay him and that he he paid for the breach of warranty as to the land and damages for the .time he lost as a result of the false representations alleged.
