II. vytf After the state penitentiary, the supreme court of Idaho sounded the . death knell of John Flemming, convicted of the murder of Frank Langford on July 8, 1908, in Lin- " LOGAN-KNITTIN- G - - ' coln county, by handing down an opinion this afternoon affirming the Judgment of the court of Lin coin county on the appeal from the death sentence of Judge Wal- ter, which was taken to the high tribunal. Their quarrel led to blows, in which Flemming got " the worst of the deal, and several days afterward he lay for Langford concealed in a hay field and brutally shot his antagonist as he drove along the road in a wagon. , He was charged with murder in .the first degree and his trial was begun September 28, 1908, the trial lasting until October 12,1908 when he Was found guilty of murkier as charged and sentenced to hang, the date of execution being fixed as December 4,4908. On October 2CI his attorneys took an appeal to the supreme which appeal acted as a of execution. Since that date the case has been pending on the appcal, .On appeal various errors were assigned, but the supreme court, by unanimous decision, affirms the lower court, and Flemming will again be condemned to die. The men sentenced are Charles Iveohoe, Edward A. Boyle, Patrick J. Hennessey and John M. Coyle. The four were checkers on the docks of the sugar company in Williamsburg, where it was discovered fhe scales used to weigh sugar imports had been tampered with. As a result the American Sugar Refining co.mpany reimbursed the government to the ex tent of more than $2,000,000 for evaded duties and employes of the company were indicted for conspiracy.
