General sales conference for Five Years In Court This famous litigation has been before the Third District Court of Salt Lake County for more than five years. On December 24, 1938, the Court made an order overruling the demurrers whfch had been filed by the defendants In the case. The demurrers were both general and specific. They set up that the plaintiffs hadn't alleged sufficient facts to give the court Jurisdiction, and numerous oiuer legal defenses were raised by the special demurrers. W rit of Prohibition Sought After the order denying the demurrers had been entered hut before time had been set for the filing of answers by tne numerous defendants, several of the Spanish Fork Irrigation companies, who were parties to the suit, brought ah action in the Supreme Court seeking a permanent writ of prohibition prohibiting the Third Court of Salt Lake County from proceeding with the action. The petition for the writ was based on a law which had been passed by the Legislature after the suit was begun, apparently attempting to throw the entire matter in the hands of the state engineer. The petition was finally heard by the Court and a decision handed down apparent ly sustaining the petition and District President Defeated In Tuesdays Relief Society and M. I. A. However, there were numerous opinions written In the case and there have been arguments ever since among the numerous lawyers representing the plalntlfrs and the defendants in the suit as to what the Supreme Court meant by its decision.
