Five years from the final approval of the notice of intent, berms will be evaluated by the Division for the presence of plant support materials (soils). If this evaluation proves that no soil is present on the berms, the operator will spread 4 to 6 inches of soil available from alluvial or colluvial deposits on adjoining claims onto the berms. When the supply of available soil is depleted, as determined by the Division, no further soil spreading will be required. Before final abandonment, maximum residual slope for bare rock will be 100 percent (45 degrees). Reject or soil piles will be graded to 30 percent (17 degrees), or less prior to final abandonment, if any such piles are left. A sign will be placed at the mine stating the mine location, operator, and operators address. Any person or agency aggrieved by this tentative decision is hereby requested to submit written protest to the Division of Oil, Gs, and Mining, located at 1588 West North Temple, Salt Lake City, Utah 84116, setting forth factual reasons for his complaint, and thereafter, at a time and place heretobe established, appear before the Board of Oil, Gas, and Mining, to show cause, if any there be, why this plan should not be approved.
