Sec. 723 2. COLLECTION BY COUNTY FROM RESIDENCES! Tlie lioard of county commissioners may provide for the collection and disposal, at the expense of the county or otherwise, of garbage, community waste, stove ashes, dead animals and other refuse and materials as set forth in Section 1 from residences, hut shall not provide for collection from places of business, ajiart-niehouses or other public buildings in Tooele County, at the of the County, but may do so by private arrangement exjx-nsand ujion the payment of due and adequate compensation for the removal thereof. COLLECTION OF board of county commissioners or its representative shall provide, on appropriate days, no less than once each month, for the collection of junk, tree limbs and other refuse that cannot be trucks. transported by packer-tyji- e Sec. 7234. COVERING OF VEHICLES REQUIRED. It shall be unlawful for any person to haul, convey or tansport through or upon any of the public streets, any garbage, ashes, market wastes, trade wastes, manure, night soil, loose paper, scrap lumber, excelsior, tree limbs, bush clippings, lawn clippings, house refuse, yard refuse, liquid wastes or any other refuse materials, in ofien trucks, open trailers, or other open conveyances, unless covered completely with a heavy duty canvas or other heavy acceptable material at all times when the vehicle is being ased for the collection of, or carrying, transporting, or hauling of garbage, manure, market waste, night soil, dead animals or other refuse, and is to be driven for a distance of five blocks or more without making a stop. It shall be unlawful for Sec. 723-5- . any person, firm, private or public corporation engaged in the collection and transportation of garbage, trade waste, nibbish or other matter of any kind, to permit, allow, or cause any of said matter to fall and remain on any property, place, building, pre. mises, street, road or highway. It shall be the duty of any jierson, firm or corporation engaged in the collection of garbage, market waste, trade waste, rubbish or matter of any kind to see and insure that all such matter is procured and disposed of by himself, his agents or employees in a manner which shall not be offensive or filthy in relation to any person, place, building, premises, street, road or highway. Sec. 723 6. MISUSE OF CARBAGE OR RECEPTACLE. It shall be unlawful for any person, firm or corporation (1) Wilfully or negligently break, deface or injure any receptacle used to contain garbage or other refuse, or to do or lermit to be done in connection with such receptacles anything which shall be damaging to the projierty of another. Garbage and refuse of every kind may, however, be disjxised of in projierly and sufficiently treated weather-resistapaper bags manufactured sjiecificallv for use in garbage and refuse collection and having a twenty to thirty gallon capacity for receiving and holding garbage, maikct waste and other refuse. Sec. 724 10. LOADED VEHICLE STANDING ON STREET PROHIBITED. It shall be unlawful for any jierson to suffer, permit or allow any vehicle loaded with garbage, manure, slop, swill, market waste or other refuse to be or remain standing upon any public street within the county any longer than may be necessary for the purjiose of loading and transporting the same. RECEPTACLES TO BE COVERED. All garbage and and market waste must be placed in metallic receptacles with projier covers, and shall be kept securely closed at all times; and shall be kept in such place and in such manner as to prevent offense. UNCOVERED CARBAGE. It shall be unlawful to Sec. 724-12- . place or permit to remain anywhere in the county any garbage, or other material subject to decay other than leaves or grass, excepting in a tightly covered metal container. . DEPOSIT ON STREETS. It shall be unlawful to deSec. or posit permit to fall from any vehicle, any garbage, refuse or ashes on any public street or alley in the county; provided, that this section shall not be construed to prohibit placing garbage, refuse or ashes in a container complying with the provisions of this ordinance preparatory to having such material collected and disposed of in the manner provided herein. BURNING OF WASTE. It shall be unlawful to burn Sec. 284-14- . any garbage, market waste or other organic or offensive refuse in the open air or in any furnace or stove within the county. It shall be unlawful to burn papers, excelsior, trade waste, or any other material which may be blown about by the wind anywhere in the heavily populated parts of the county unless the same is burned in a stove, fire place, furnace or in an incinerator sufficiently fine to prevent the escajoe of ighited particles. In farming areas of the county it shall be unlawful to burn such waste material which may be blown about by the wind unless the same is burned in a stove, fire place, furnace, incinerator or sufficient receptacle in an area that is open and free of buildings, machinery, grass, crops and foliage of any kind that could be ignited or damaged in any way by scattered particles. It shall be unlawful to bum grass or leaves at any time except between the hours of sunrise and sunset. LOOSE TRADE WASTE. It shall be unlawful for Sec. 724-15- . any person to place or cause to be placed upon any street or alley for the purjxise of collection or otherwise any loose paper, excelsior or similar trade waste. All such trade waste must be baled or placed in adequate recejitacles for receiving and holding such refuse. DEAD ANIMALS. It shall be the duty of every Sec. 724-16- . owner of any animal found dead within the county, to immediately notify the board of health of the location of such animal, so that the same may be removed as sjieedily as possible. The prosisions of this ordinance are severable and in the event that any of the jvrovisious are to lie found invalid, the invalidity shall not affect anv of the other provisions of the ordinance which shall remain in full force and r ' effect. Sec. 723-2- . PENALTY. Any jierson, firm or corporation violating any provision of this ordinance shall lie fined not to exceed $2'W.OO or imprisoned in the county jail not to exceed six months, or by both for each offense; provided, that a coqxiration violating a provision of this title diall lie jxinished by a fine not exceeding one thousand ($1,000.(8)) dollars. A sejiurate offense shall lie deemed committed on each and every day that a violation continues or is rejieated and shall lie jxinisliable as a sejiaratc violation and may receive maximum punishment as set forth almve for each violation. When an occupant of any premises fails to pay the fee for removal of garliage, refuse or ashes, the Imard of health shall notify the occujiant of this fact and diall refuse further collection until the required fee is paid. The fact that garbage, night soil, dead animals, refuse or ashes remains on an occujiant's premises in the county in violation of this ordinance shall lie prima facie evidence that the occupant of such premises is resjxmsihle for the violation of the ordinance occurring. In the opinion of the County Commission it is necessary to the peace, health, safety and welfare of the residents of Tooele County that this ordinance shall take effect immediately ujxin its first publication.
