Show LEGAL NOTICES ORDNANCE NO. 70-- 3 AN ORDINANCE AMENDING THE EXISTING COUNTY ZONING RESOLUTION. . BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF TOOELE COUNTY, UTAH: The Tooele County Zoning Resolution follows: Section is TOOELE COUNTY hereby amended as Article VII, ESTABLISHMENT OF ZONES, as amended to add a new zone titled P Planned Zone. 2: Article VIII, REGULATIONS WITHIN ZONES, is amended to add a new section to read as follows: 1: Section 3 P Planned Zone General Objectives and Characteristics of Zone: The P Planned Zone is established to encourage and provide a means for effectuating desirable development, redevelopment, rehabilitation and conservation in Tooele County, which features or may feature variations and relationships in land uses or mixed land uses, siting, and dwelling densities and types from those permitted in any one other zone herein. The amenity and compatahility of land uses and densities of P Zones are to be insured through adoption of a general development plan, showing proper orientation, desirable design character, and compatable land uses and densities. Standards and Requirements for P Zones: The following provisions shall apply to all use of land in P Zone; all other provisions of this Regulation shall also apply to use of land in the P Zone, except that where conflict in regulations occurs, the regulations specified in this Section or on an approved general development plan shall apply: 1. P Zones may be established to cover land areas which are suitable for, and of sufficient size to be planned for development consistent with the general objectives and characteristics of the P Zone; such zones shall include no less than four acres of contiguous land. 2. No ordinance establishing a P Zone shall be adopted unless and until there is on file with the Planning Commission written consent of every property owner within the Zone agreeing to the conditions and regulations to be effective within the Zone. 3. Standards for land use, density, land coverage, yard requirements, parking, screening, and other elements covered by the Zoning Resolution shall be generally governed in the P Zone by the highest standards of other zones for similar uses, except that modifications may be allowed by the Board of County Commissioners through adoption of the P Planned Zone and the general development plan therefor when the Board finds that such exceptions encourage a desirable living or working environment and are warranted in terms of the total development or unit thereof. Standards for public improvements shall be governed by applicable laws and regulations of the County, except as may be modified by such approved general development plan. Procedure and Applications: 1. Development Plan. Prior to the filing of a formal P Zone rezoning application the applicant shall submit a Development Plan for approval in principle thereof by the Planning Commission, before submission of a rezoning application to the Board of County Commissioners. The development Plan and text shall be prepared and endorsed by a qualified urban planner and shall include the following information presented in a general, schematic fashion, but in sufficient clarity to allow mutual understanding of the proposal: r, --T'-' (a) A map showing proposed land uses, ' population density, and building in i , ' "" tensities. (b) A map showing and transportation facilities. A map showing proposed parks, playgrounds, school sites and other permanent public or private open spaces. com(d) A market analysis of proposed mercial and industrial uses if the land to upon which such uses are proposed ' be located is not zoned for such uses at the time of Application. Consent of Property Owners. The written consent of all property owners within the proposed P Zone shall be filed with the Planning Commission when the preliminary development plan is submitted for consideration. 3. Development Plan Approval. The development plan shall be studied by the Planning Commission and its Staff and reviewed with the Applicant. The Planning Commission may request but not require changes in the Application. Upon completion of the review by the Planning Commission, the proposal shall be submitted to the Board of County Commissioners as a rezoning application for public hearing, with the recommendations of the Planning Commission. After public hearing, the Board may deny or approve the P Planned Zone amendment, but such approval, if granted, shall be based on the development plan as presented at the hearing or as required to be amended by the Board, and such approval shall require that all uses in the P Planned Zone shall be conditional uses requiring conditional use permits and that the entire development, as a unit or in several units, shall be submitted to the Planning Commission as Planned Unit Developments for approval of precise proposals as provided for in 8 - 12 of this Resolution. Article VIII is further amended by changing to read as follows: The Purpose of the planned unit development is to allow flexibility in locating various buildings, structures, open spaces and uses together with the allowable heights of buildings and structures in planned units. Substantial compliance to the District Regulations and other provisions of this Resolution shall be met in order that the intent of this Resolution in requiring adequate standards related to the public health, safety, and general welfare shall be observed, without unduly inhibiting the advantsite planning for ages of large-scal- e residential, commercial, industrial or other purposes. In order to insure such substantial compliance to Disno Planned Unit trict regulations, Development shall permit uses or population densities not allowed in the zone in which the land is located, except that Planned Unit Developments in a P Planned Zone shall allow uses and densities permitted by the approved development plan for public and private streets and other circulation proposed Section 3.
