I PRIMARY ELECTIONS RESOLUTION PROPOSING TO ADD TO ARTICLE 6 OF THE TOOELE CITY CHARTER A SECTION TO PROVIDE FOR A NOMIPRIMARY NATING ELECTION TO SELECT TWO CANDIDATES FOR EACH OFFICE WHEN MORE THAN TWO CANDIDATES FILE FOR THE OFFICE OF MAYOR, OR WHEN MORE THAN TWO CANDIDATES FILE FOR EACH THAT SAID OFFICE OF COUNCILMEN; PRIMARY ELECTION FOR SUCH NOMINATION SHALL BE HELD ON THE. It is proposed to add to Article 6 of the Tooto read as follows: ele City Charter Section Candidates for Mayor and Councilmen to be voted for in Tooele City Municipal elections shall be nominated by a primary election, and no name shall be placed upon the Tooele City Ballot except those selected in the manner hereinafter prescribed. The primary election for such nomination shall be held on the second Tuesday preceding the Tooele City municipal election. The judges of election appointed for the Tooele City municipal election shall be the judges of the primary election. The primary election shall be held at the same places, so far as possible, as the Tooele City municipal elec tion, and the polls shall be opened and closed at the same hours. ' Section 2. It is proposed to amend Article 6, Section 3 of the Tooele City Charter to read as follows: , Any qualified elector of the city of Tooele may be nominated for any office made elective by this charter by a petf tion signed by not less than ten such electors who shall be designated as his sponsors. No elector shall sign more than one such petition, and should an elector do so, his signature shall be void except as to the petition first filed. With each signature shall be stated the place of residence of the signer, giving the street and number or other description sufficient to identify it. Nominating petitions shall be signed and filed with the city recorder at least 21 days before the primary election and shall be in substantially the following firm: We, the undersigned electors of the City, of Too' : ele, hereby nominate and sponsor for the whose residence is office of to be voted for at the election to be held on day of 19 and we individually cer, , tify that our names are on the rolls of registered voters and that we are qualified to vote in the aforesaid municipal election , and that we have not signed any other nominating petition for that office. That there is hereby granted to Utah Power and Light Company, its successors and assigns (herein called the "Grantee), the right, privilege, or franchise (until October 10th, 2019) to construct, maintain and operate in, along, upon and across the present and future roads, highways and public places in Tooele County, Utah, and its successors, electric light and power lines, together with all the necessary or desirable appurtenances (including underground conduits, poles, towers, wires, transmission lines, and telegraph and telephone lines for its own use), for the purpose of transmitting and supplying electricity to said County, the inhabitants thereof, and persons and .corporations beyond the limits thereof, for light, heat, power and other purposes. Section 2. Poles and towers shall be so erected as to interfere as little as possible with traffic over said roads and high-- , ways. The opening of roads and the erection of poles and towers shall be controlled by the ordinances of said County,' but will not be made so as to unreasonably interfere with the proper' i . operation of said lines. Sertion 3. All lines constructed under this grant shall be constructed in accordance with established practices with respect to electrical construction. Section 4. The County shall in no way be liable or responsible for any accident or damage that may occur in the construction, operation or maintenance by the Grantee of its lines and appurtenances hereunder, and the acceptance of this franchise shall be deemed an agreement on the part of said Grantee, its successors and assigns, to indemnify said County and hold it harmless against any and . all liability, loss, cost, damage or expense which may accrue to said County- by reason of the neglect, default or misconduct of the Grantee in the construction, operation or maintenance of its lines and appurtenances hereunder. Section 5. The Grantee shall file its written acceptance of this franchise with the County Clerk within thirty (30) days after its passage. Section 6. This ordinance shall take effect as soon as it shall be published, or on the fifteenth day after its shall occur later. Section 7. This ordinance shall be in lieu of and shall supersede all prior franchises granted to Utah Power and Light Company by Tooele County. No nominating petition shall be accepted unless accompanied by a depot of $25.00. The City recorder shall issue a receipt for the deposit and record the receipt number on the petition. Such' deposit shall be returned to the person of record filing the petition if the candidate becomes ineligible or withdraws from the election, or if he polls at 'least ten percentum of the total votes cast for the office he is seeking; but if he remains a candidate and fails to receive the required number of votes, the deposit shall be forfeited and paid into the general fund of the city. Any candidate may withdraw his nomination not later than the last day for filing nominating petitions by filing a notice of withdrawal with the city recorder. Within five days after the filing of a nominating petition,, the city recorder shall notify the candidate and the person who filed the petition whether or not it is found to be signed by the required number of qualified electors. If a petition is found insufficient, the recorder shall return it immediately to the person who filed it with a statement certifying wherein the petition is found insufficient and the deposit of money made at the time the petition was filed. Within the regular time for filing petitions new petition may be filed for the same candidate. Section 3. The Tooele City Recorder is directed to submit this proposed addition of section and amendment of section of the Tooele City Charter to the electors of Tooele City at the next municipal election in the manner provided by law. Section 4. If adopted by the electors of Tooele City, this addition of section and amendment of section to the Tooele City Charter shall take effect the first day of January, 1970.
