No nominating petition shall be accepted unless accompanied by a depot of $25.00. The City recorder shall issue a receipt for the deposit and record the receipt number on the petition. Such deposit shall be returned to the person of record filing the petition if the candidate becomes ineligible or withdraws from the election, or if he polls at least ten percentum of the total votes cast for the office he is seeking; but if he remains a candidate and fails to receive the required number of votes, the deposit shall be forfeited and paid into the general fund of the city. Any candidate may withdraw his nomination not later than the last day for filing nominating petitions by filing a notice of withdrawal with the city recorder. Within five days after the filing of a nominating petition, the city recorder shall notify the candidate and the person who filed the petition whether or not it is found to be signed by the required number of qualified electors.
