Bob (Robert Steele) has spent a lot of time researching state law concerning tobacco use and minors, said David Leavitt, county attorney. He said he had reviewed the material sent by the tobacco company and could concur with Steeles findings. Leavitt was directed by the commission to write a letter to the Ute Stampede Committee to forward to Skoal officials. The letter will state the legislation which affected the commission decision. It is a class B misdemeanor for any person to display on any billboard, streetcar sign, streetcar, bus, placard, or on any other object or place of display, any advertisement of cigarettes, cigarette papers, cigars, chewing tobacco, or smoking tobacco or cigars or any disguise or substitute of either, except annexation. I thought Nephi City had already annexed that, said Robert Steele, who is the former mayor of Nephi. Roads do generate money for the county, said Robert Garrett, county road superintendent, and we need to know how much . roadway is included in the annexation. The bridge on that road is fairly dangerous, said Howarth, and several accidents have occurred there. However, none of the commissioners could tell, from the map provided, how much roadway would be included or if the road would still belong to the county or if it already belonged to the city. The annexation would incorporate 31 acres which now belong to the county but, following annexation, would belong to Nephi City, said Howarth. None of the commissioners had any objections they wanted the city to consider before annexation. However, they would like to know if the road would belong to the city or to the county, following annexation acceptance. The property this (the county) building is sitting on belongs to the county but is located in the city, said Mike Seely, county administrator. The roadway, Main Street, belongs to the city but is maintained by the state. This (informing the county) is just one of the steps the property owners have to take under the state statute, which spells out the annexation procedure, said Steele. City and county government are to control the advertising of tobacco products, he said. Under terms of the law, law enforcement officers of the county and city have been charged to keep tobacco product advertising from being done in any way that does not comply with the law. Having the word Skoal emblazoned on the scoreboard would not meet the restrictions of the advertising rulings imposed by the state. If the advertising were allowed, he said, then the county commission, as the ruling body, could be charged with a class B misdemeanor. Steele said, if the Stampede would be substantially improved by the use of a 2.
