Show Serving East Juab County - A Nice Place Commission says Restaurant Tax Check should have been higher Correspondent The check amount sent by the state of Utah to Juab County to pay the tax which came from restaurants in the area was questioned by commissioners. I dont think this amount can be a true representation of the business the county restaurant business does, said Gordon Young, commission chair. The check, for $143,461.70, is to represent the tax which those who patronize local restaurants are charged. The restaurant then passes the tax on to the state and the county receives an amount in return. Commissioner Ike Lunt said he thought some of the local restaurants and fast food outlets must not be paying the tax. Mike Seely, county administra-torassistanwas asked to contact the Utah State Tax Commission to insure that all restaurants in the county were paying the restaurant food tax. Lewis Herring, a landowner near Mammoth in West Juab, still would like a road to his property designated a Class B t, Road. I do not understand your objections, said Herring. I will build the road, maintain the road, and allow the public to use the road. When Juab County Commissioners said they did not think it was a good idea, Herring asked if the roadway request could be tabled until the next meeting. Herring insisted that the Bureau of Land Management would grant an easement to construct part of the roadway into the private property. In a preliminary discussion with BLM officials he had been told he would be allowed the permit. I build homes for a living. I am capable of building a roadway into the property which will be graded and will have the necessary culverts. I am a professional contractor and will build the road to specifications, he said. I have the equipment to do the work. I plan to be and will do the snow removal and the maintenance on the road, said Herring. He said he has a water permit on 80 acres and plans to construct two private homes on the property. He plans to have a goat dairy on the property. Ike Lunt, commissioner, said Herring would have to build the homes so they were serviced by an existing roadway. It is part of our zoning ordinance, he said. Joseph Bernini, commissioner, said he was concerned about what would happen in the future. If you sell the property, then who will maintain the roadway. It will end up being the county, said Bernini. Herring said the commission could require a bond which would assure that the roadway maintenance would go with the property if it were sold. It took 40 minutes for a bomber carrying fire retardant to come from the Spanish Fork Airport and return there for another load. Council members think the airport easements will preserve open spaces and will only impact tall buildings not allowing them to be built on the farming land in the future. Coimcil members have also taken a stand that the airport will not have a negative impact on Central Utah Project water which is to be delivered to farms in the area in the future. Times-New- s Correspondent Juab County Commissioners denied a plea made by Lewis Herring, a landowner near Mammoth in West Juab, to designate a road to his property a Class B Road. I am assuming he could not get the proper agreements from BLM, said Gordon Young, commission chair. Yes, we told him to only come back if he could get the agreement and then we asked him to bring it with him, said Ike Lung, commissioner. Earlier Herring had told commis- sioners he would build the road, maintain the road, and allow the public to use it. He also agreed to bond for the road and to sign legal agreements which would make it so the road would have to be cared for under the same sort of strict rules by a new purchaser as the rules to which Herring agreed. When Juab County Commissioners said they did not think it was a good idea. Herring asked if the road way request could be tabled. Last Monday was the end of the period the commission had agreed to table the request. Lunt said Herring would have to build the homes so they were serviced by an existing roadway. It is part of our zoning ordinance, he said. The plan was made so the county would not have to be responsible for making roads all over the county to homes people built after they were built. Herring had insisted that the Bureau of Land Management would grant an easement to construct part ofthe roadway into the private property. In a preliminary discussion with BLM officials he had been told he would be allowed the permit. Joseph Bernini, commissioner, said he was concerned about what would happen in the future.
