The citys stated intention is to negotiate with the owner of the property. Only if that fails, said Leavitt, would the city exercise the privilege of eminent domain. Clifford Jensen, owner of the property, does not live in the area. He purchased the property some years ago to give his n sons some needed work to do in the summertime. It was Jensens stated intention at the time to make his boys into fine men by having them learn to work on a farm. Timmerman said he objected the city stepping in to take a persons livelihood away from him. He also objected to the city taking any land for the purpose of providing recreation for the comnow-grow- munity. Does it go against your conscience? he asked. We do not want to take a mans livelihood, said Chad Brough, city council member. The city council now, and others in the past, had tried to develop an area in the city which would house four baseball diamonds and supply adequate property. We had generally considered the east end of the community would provide the best site, said Brough. However, one plan after another had fallen through. For example, a plan to expand the complex from two ball diamonds to four at the present site failed. The city purchased additional property, he said, but still did not have enough. Timmerman suggested the city approach the LDS Church and ask for permission to use the church ball complex. We have already tried to negotiate with them, said Steele. The church needed the ball park for their own use so often that a schedule for city teams was difficult to arrange. Recreation was an important Nephi, Utah 'ftlfje consideration, said Steele. It is important to those who consider moving here and for those who already live here. Steele said the city had been stalemated for 100 years. From the late 1800s to the late 1980s, he said, the population of the community was fairly stagnant. We had approximately 3,500 people for many years, he said. Only recently the community had begun to grow. More than 1,000 residents at 4 percent growth annually, had moved to Hie area. The city had also recently developed a new master plan and had been through the public hearing process. We learned people do want recreation, they want a certain number of parks, and other facilities, said Steele. The main issue, said Steele, was where the best place to construct the city ball park complex would be. If we work with the county, said Steele, we can have a good parking area which we can both use and save ourselves a bundle of money. Timmerman said he did not think recreation was the kind of use the founding fathers had in mind when they allowed eminent domain. Gov. You objected and sued the federal government over whether you should be allowed to mine your land in the Wilderness designation. He said those who ride the freeway, such as Timmerman, to travel to work each day should realize that a lot of private land owners had land taken for the freeway to be constructed. The planning commission is appointed by the city council, said McKnight. Five members are appointed to the board with each serving a five year term. The terms were staggered when the board was first set up so no appointments would come at the same time. By vote, the board selects a chairman and sets up its own operating policies, said McKnight. The members of the planning commission, said McKnight, are to prepare an agenda, research questions, keep minutes, among some of their duties. They are responsible for managing the general plan and assuring compliance with community desires. They have the authority to is for you to reconsider and rescind your decision. We have already had public hearings on the county and city recreation master plans, said Brough. Timmerman said he still thought the city should not take a mans property for recreation.
