Lahey was found guilty by a jury in the federal court Wednesday afternoon of assaulting a lederal prohibition oincer. Trie Jury recommended that Judge Tillman D. Johnson extend leniency In passing Judgment The assault was alleged to have taken place on March 6, 1928, at the defendant's place, 263 Twenty-fourt- h street Earl A. Patterson, federal officer, and Roland Swan visited the place and called for drinks, which they allege were served by Lahey. It was when Patterson reached for a bottle of whisky. Informing Lahey that he was an officer, that Lahey Is said to have struck the officer, knocking him down and beating him. Patterson reached for his revolver and E. Johnson, a roomer at the place, took 11 from the officer. Lahey, on the witness stand, admitted the assault but declared that Patterson did not advise him he was a federal officer until he was leaving the place. This testimony was cor ro bora ted by Johnson. OODEN.
