Approval of the house joint memorial, urging United States congress not to enact legislation now pending before that body reserving surface rights to the government of mineral claims on forest land, passed the senate. The memorial stales that, since 36.3 per cent of the total area of Idaho is within the boundaries of national forests, and since practically all of this forest land is potential mineral land, the measure now be to fore congress is of Idaho. I Past experience has demonstrated beyond doubt that development of many mining properties h "depended upon the right to use timber accessible by virtue of surface rights accruing to the claims, exponents ot the bill assert. Senate biU No. 5348, now before congress, la therefore declared to be unjust to developers of mineral " land; and likely to cause continual conflict between mineral claimants and forest reserve officials. It will not protect the small claim owner from having all timber removed or sold from his claims, whether the timber is essential to the development of the property or not. the memorial contends.
