The only indication of said interest is contained in a Notice 1-- dated September 3, 1957, executed by White Canyon Mining Company, and recorded November 19, 1957 in Book 196 7 at pages in the Records of San Juan County, Utah. Said Notice refers to an unrecorded Agreement entered into August 1, 1957 wherein an unspecified interest in the revenues from production from the above listed mining claims is purported to be granted to Defendant Alvin I. Smith. No terms, provisions or details of said Agreement of August 1, 1957 are specified in the recorded Notice, and further information pertaining thereto is unknown to Plaintiffs. 7. Plaintiff, through its attorney, John Preston Creer, has attempted to locate Defendants and learn further details of the nature and extent of the interest claimed or asserted by Defendants, or each of them, without success. Plaintiff therefore denies that Defendants have, claim or may 536-53- adversely claim against the exclusive ownership and possession of Plaintiff in said mining claims. WHEREFORE, Plaintiffde-man- ds judgment against the Defendants as follows: 1. That the Court determine that Defendants have no legally enforceable interest in the subject mining claims, or any 8-i- nch 29, T38 1-- lawfully assert any interest of whatsoever nature in the subject listed mining claims or 33, T38S, RUE.. Area); and used for do- mestic purposes same as heretofore with the addition of 204 families; and used for other same as heretofore with the addition of 100 unit mobile home park and all uses incidental to the operation and administration of the National Park Service Halls Crossing facility; and used from Mar. 15 to Nov. 15 for the irrigation of 2.0 acs. in Sec. Defendants C. W. Thompson and Barbara Thompson relates only to the Cedar Nos. 3, 37-4- 4, 6, 20, 27-3- 2, 9, and Kangaroo Dingo Nos. Nos. 1 and 2 unpatented lode mining claims. The only indication of said interest is contained in a Notice dated September 3, 1957, executed by White Canyon Mining Company, and recorded September 26, 1957 in Book 198 at pages 193-19- 6 in the Records of San Juan County, Utah. SaidNotice refers to an unrecorded Agreement entered into August 1, 1957 wherein an unspecified interest in the revenues from production from the above listed mining claims is purported to be granted to Defendants C. W. Thompson and Barbara No terms, proThompson. or details of said visions Agreement of August 1, 1957 are specified in the recorded Notice, and further informa- of them. 2. above listed mining claims, and Plaintiff and Plaintiffs predecessors in interest have been in actual possession of said mining claims for a period .of more than ten years, and have timely done the required annual assessment labor required by law to maintain each of said mining claims. The continued possession and occupancy during the past ten years by Plaintiff and its predecessors in interest has been open, exclusive, continuous and hostile with respect to all third parties, including Defen- dants in this action. There has been no severance of any minerals from said mining claims since Plaintiff has been in possession and occupancy. 5. The interest, if any, of That Defendants be forever barred and enjoined from further asserting any claim or demand as to any of the above-nam- ed mining claims. 3.
