ORDINANCE NO. 10-6-- AN ORDINANCE REGULATING ROADWAY . RIGHT-OF-WA- Y ENCROACHMENT Emery County is experiencing ; pronounced population growth and mineral development; and WHEREAS, said growth and development ; necessitate frequent encroachment upon County ; roads for vibroseising and for the installation of utilities; and . WHEREAS, the County is without adequate regulations to uniformly control such en- croachments; : NOW, THEREFORE, be it ordained by the i Emery County Commission that the following be y ; enacted as lav regulating roadway .encroachments: - A. Encroachment means the disturbance of ; any roadway, whether by excavation, boring, or extraordinary obstruction, vibroseising, short-teruse. B. Supervisor means the Emery County Road ; Department Supervisor or any representative him. appointed duly ' C. Permits forbyRoadway Encroachment: ; 1. It shall be unlawful for any person to en- . croach upon any Emery County roadway without ; having first obtained a current Permit from the road supervisor. 2. The procedure for obtaining an encroachment permit shall be as follows: i a. Any party desiring to encroach upon an existing Emery County roadway must first make i application for a permit by fully completing an ; Application form and a Utility Line Agreement ; form, both of which shall be provided by the Emery County Road Department. The road t supervisor shall review the completed forms and i shall notify the applicant within a reasonable ; time of any deficiencies. -- : b. Upon acceptance by the road supervisor of 1 tne Application and Utility Line Agreement, the ; road supervisor shall issue to the applicant a ; Permit for roadway encroachment. Any entity, whether public or private, who ; engages agents, general contractors, or sub-- I contractors for a project that requires roadway I encroachment shall require said agents, general contractors, or subcontractors to comply with - the provisions of this Ordinance. Any entity I violating this provision is guilty of a 7 misdemeanor. -, 7.
