The State Land Board filed an injunction to prevent the county from selling the lands, claiming that the land was tax exempt and therefore could not be sold for taxes. The county won its case in the District court and the State appealed. The Supreme Court upheld the decision rendered by District Judge Abe W. Turner, upsetting precedents in four states, and the state tad to pay the delinquent taxes to Duchesne county. The question of current assess- ment and was not an taxation issue in that case so the Supreme Court could not render a decision on it at that time.
