Gardner, Welby rancher. May 20 for the murder of Deputy Sheriff Gordon Stuart, Judge Ephraim Hanson of the Third district court announced yesterday morning, after the Jury In the ease returned a verdict of guilty of njurder, wfthout recommendation. The Jury reached an agreement after deliberating Wednesday night and yesterday morning for nearly six hours, during which tima eight ballots were taken. On the flrat ballot evening, nine jurymen favoredWednesday a verdict of murder. The other three Jurymen did not make their opinions known, cept that they were not In sympathy with a verdict of murder In the flrat degree. When the Jury retired for the night at M o'clock, eleven jurors announced a willingness to return a verdict of guilty to a charge of murder, without making a recommendation. The remaining one held out tor a recommendation of life Imprisonment. When the Jury resumed Its deliberations yesterday morning the members still stood eleven to one for murder. On the third ballot, however, all twelve members favored a straight verdict Of guilty, without recommendation. The agreement was reached at $20 o'clock, nearly two hours after the morning meeting of the Jury. The defendant appeared In the courtroom pale and worn. Apparently he had gained hla composure sluoe Wednesday, when he broke down and wept, for it was Impossible to discern hla emotions during the reading of the verdict. He did not talk to hla attorney or others about the finding of the Jury. Gardner killed Stuart and mortally wounded Joaeph W. Irvine after i they cam to hla farm near Welby April 14 with several other deputy sheriffs and friends of Irvine to replevin some stock and Implements claimed by the latter. Gardner Invited Chief Civil Deputy Sheriff Frank M. Mathews and Daputy Sheriff Stuart Into the house to talk it over," procured a shotgun from behind a door, and whirling, quickly wounded Stuart twice. The two deputies ran from the house, Stuart falling dead about sixty feet from the rear door of the dwelling. Then Gardner mounted a horse and overtook Irvine, who had fled down a ravine, shooting him through the Jaw and neck. He died several daya later. The state Insurance fund is making the payments authorised under the workmen's compensation law to the widow of Stuart. It was necessary, in compliance with . the law. that the widow should obtain the right of guardian of the baby of the dead deputy sheriff, but no formality was permitted to cause any delay in the payment of the claim, officials say.
