The public hearing of the pition of Brigham City before the Public Utilities Commission on Teusday, or permission to increase its electric light rates, had its amusing side. The smiles came when representatives of the Terry Electric Light & Power Company protested the proposed increased rate for the reason that it Is unjust discrimination1 against them. The members of the Utilities Commission smiled broadly when it was stated that the electric light and power company operating in Perry, purchases its current from Brigham City at the rate of nine tenths of a cent per kilowat hour. This city is asking permission to increase the rate to 4 cents per kilowat hour, which the Perry purchasers declare is an in crease of over 200 and claim is unjust. At the same time it was admitted by the protestee that the v entire electric light line in ' Perry has practically been built and paid tor by the profits on the deal for the operating company r Charges 5 cents per kilowat for the current It purchases from this city at nine tenths of a cent. While the Perry Electric Light & Power Company is asked to pay four cents for its current, the people of Brigham City, who own the power generating plant, are asked and are willing to pay seven cents. We ask just where is the unjust WHY IS A FRANCHISE At the hearing before the PubllcUtil-itie- s Commission in the City Council ' chambers on Tuesday,' Manager W., A. . Whitney of the U. I. C.' railroad company declared that his company 'was heartily in accord with the proposed street improvements in Brigham City but could not join' in defraying the expense because of lack of funds. . He threatened that if the improvements are made, the company will fffTpear before the Utilities Commission and petition for permission to take up their track along Main and Forest street. ' When the electric railroad was to operate its road granted a franchise over the streets of Brigham City, Just what did that franchise mean? Is it to be assumed that a franchise in no to any compensation the grantor but is wholly for the protection and benefit of the grantee? In other words, when the electric railroad company was given a framhise to biuld, maintain and operate an electric railway system over the Btreets of Brigham City, the granting of the franchise was the important thing to the railroad company for until ' the City Council had voted to grant the petition, the raDroad company was estopped from entering the precincts of the city. So it is clear that a franchise is the first essential to the promotion of such enterprises within any organized community. But does not the granting of a franchise entitle the city to some consideration at the hands of the grantee? Too often, we are sorry to admit, franchises are passed out without any reservation and it Is not long until such action Is repented oL Hut in the present Case, we believe the way-'provi- franchise specifically states that when- ever any street improvements are made, the street railway company must "bear a' certain portion of the expense and the point is now raised, can the railroad company, because it does not want to assume the extra burden -- F OUR STREET IMPROVEMENTS While the members of the Public Utilities Commiss.on were not in a position at the close of the hearing to render a decision on the petitions of Brigham City to rebuild its street lighting system and increase its electric light rates to meet the expense of that improvement, thepet!tions in each case were practically - unopposed at the hearing held in this city on Tuesday so It is warrantable to assume that the petitions will be granted. City Manager Roskelley has. all the preliminary work completed In order to launch the Improvements Immediately permission is granted and the chairman of the commission declared that it would not necessarily take long to arrive at a decision. As soon as the word comes, Brigham City is ready to advertise for bids immediately. Some of our worthy citizens have expressed some dubiety of the wisdom of making these improvements because it means the Increasing of the light rates and that bugaboo of more taxes is so terrible to some that it simply takes the joy out of life continually. But if the thing is considered just a moment, all the fears vanish and the supposed extra burden simmers down to a very respectable little parcel that can be borne with scarcely a reminder that It is an extra burden. For instance, according to the records, the majority of light users in the city, at least those who are the most fearful of the extra burden, pay on an average of $1 per month for their electrical current. If the rate is raised from five cents to seven cents the Increase on that basis would , be just forty cents per month or 4 80 for the year and. in lieu of that extra light tax the people will have the pleasure of looking upon a modern and beautifully Illuminated business district and have the added convenience of the removal of all the poles from the center of the street the full length of Main street and from Forest street between Mala and the O. S. L. Depot. After taking a good Bquare look at these bare facts what citizen would object to paying the extra light rate in order to get the magnificent ' improvements It wT proviie? As a matter of fact, the city recorder Informs ns that the great majority of light users pay less than one dollar per month for the current they use and so the increased tax would be less than forty cents per month. , We have talked about these improvements pat five or six years and now we have come to the point where our dreams are about to be realized. And the realization of that dream will bring such flood of civic pride and gratitude that we will feel that the Improvements were justified no matter if the cost had been double. for-th- RESOLUTION. Whereas, the City Council of Brigham City has been petitioned by citizens and taxpayers of Brlghac City to cause to be constructed additional sidewalks as hereinafter described; And, whereas, the Council deems it for the best interests of the City and the citizens thereof that such improvements be made; Now, therefore, be it resolved that the wishes of the property owners referred to be complied with and that said paving district be created, assessments made,! bids advertised for and such steps taken as the law requires for the creation ot said district; Now, therefore, be it further resolved that the Mayor and City Recorder be and they are hereby authorized to have published for the time required by law in at least one newspaper having general circulation within the City the following notice of intention to make the improvements as in said notice set out: e fi Notice of Intention.
