City Ordinances Explicit On Subject Page 117, section 51 of the City Ordinances of Brigham City, reads as follows: Every person owning a City lot, or land adjoining any such sidewalk is hereby required to keep said sidewalk in good repair." .Section 52 Whenever a sidewalk is 6ut of repair by reason of the act or omission of any person, the same shall be repaired by such' person, or at his expense by the supervisor." Section 53. "Whoever falls or to keep the sidewalk in front ef his lot or place of business in good repair and free from obstructions, shall be liable to a fine not exceeding One Hundred Dollars." The foregoing ordinances appear to be very clear, but we will briefly refer to section 52, which provides that any person damaging the sidewalk shall bear the expeuse of repairing the same. If he doesnt do it himself the Supervisor of Streets may make necessary repairs Bod assess the damages against the proper person or persons. In last weeks issue we called attention to the bad condition of Forrest Street, extending one block West from Main Street. It would be a difficult matter to fix the responsibility for the neg-leo- ts . , damage to these walks. The principal damage has been done by water overflowing from Main Street and the small irrigating ditches bordering the walks; also, it has been, a long time since the walks were graded and constant use has worn them down. We believe that the City Officers, and the business men on t,bnt Street, could get together ami have the necessary repairs made before the season is too far advanced. Some of the business men have expressed their willingness to bear their portion of the expense. Our city Supervisor is wide awake and energetic, which is evidenced by the many pleasing improvements In our streets everywhere, consequently we are satisfied that if the matter can be attended to at this time it will be done. The City Council Is very muoh concerned over the matter of culverts crossing the sidewalks. It Is expressly the duty of property owners, and those who use the culverts to keep them in good repair. An accident caused by one of these culverts might at any time precipitate a lawsuit againRt the city and cause a great deal of An ounce of preventive trouble. is better than a pound of cure."
