The purpose of this chapter is to establish procedures for the termination of severance pay and health benefits where a statutory appointee, as defined by Section 2.10.040 (C) with the exception of the City Attorney, is terminated for cause by action of the Mayor and the City Council. It is the express intent that all statutory appointees shall remain ll as employees serving at the pleasure of the Mayor and the City Council, and the procedures provided undpr this chapter shall appjy only to the question of denial of severance benefits. Nothing in this chapter shall be construed to repeal or modify the appointees status. 2.61 028 Termination for Cause. A. Notwithstanding the appointee's at will status, the Mayor and the City at-wi- ll Council may elect to terminate any statutory appointee for cause, which cause may include, but shall not be limited to, any conduct prohibited by Section 8.1 of the Moab City Personnel Policies and Procedures Manual, or any other serious misconduct, malfeasance, unlawful conduct in office, or misuse of office warranting dismissal. B. The effect of dismissal for cause shall be the loss of severance pay and health benefits mandated for statutory appointees by resolution. The loss of benefits shall not be regarded as a fine, penalty, or punishment. 2.61.030 Dismissal Pro- cedure. A. Prior to dismissal for cause the Mayor shall deliver to the statutory appointee written notice of the alleged misconduct and the appointee shall be entitled an informal hearing and an opportunity to present evidence in response to the charges. B. Should the hearing result in dismissal the appointee shall be entitled to appeal to the full City Council. Written no- tice of the appointees intent to appeal shall be delivered to the City Manager no more than seven working days from the notice of termination. Failure to deliver a notice of intent to appeal within the time provided shall result in the waiver of all appeal rights. .C. The Council shall hear any evidence and arguments with regard to the appointee's appeal, which shall be conducted on the record. The pro- ceedings may be conducted informally and shall not be subject to the rules of evidence. The Council shall render a decision based upon the evidence provided at the hearing, upon a majority vote, whether the termination for cause is sustained or reversed. The Mayor shall not vote or participate in the appeal hearing, except as a witness to provide testimony or information as to the basis of the termination for cause. D. In the event the basis for termination is re- versed the appointee shall be entitled to all severance pay and health benefits provided by Council resolution, but shall not be entitled to reinstatement to hisher position. If the basis for termination is sustained the appointee shall be entitled to seek judicial review on the benefits issue, provided the action is timely commenced within thirty days of the governing bodys decision. E. Exhaustion of all administrative remedies shall be a jurisdictional prerequisite to seeking judicial review. Review shall be limited to the record below and the court shall not reverse the decision of the governing body unless it is arbitrary, capricious, or not supported by the evidence. F.- AII hearings shall be conducted in closed session, unless the appointee consents to a public hearing. This ordinance shall take effect immediately upon passage. The Rural Water Association of Utah is pleased to announce it awarded Larry Johnson of Moab City the Outstanding Water or Wastewatec vice To Customers award at their 1998ATW(i Technical Management Conference in St. George on February 25th. The award was presented by Director Dan Fleming. Larry has worked for Moab in the water and wastewater systems for over 30 years. Hes been Water Lead Worker, Utility Supt., and Water & jSewer Supt. Hes certified for both water distribution and sewer collection. He has been responsible for a number of improvements to the Moab system. In addition to his work with Moab City, Larry has also provided assistance and training to neighboring systems such as Spanish Valley Water and Sewer Improvement District, Thompson Water District, and Grand County Water Conservancy District. Larry has spent countless hours, both day and night, to insure that the citizens of Moab have the highest quality water possible. The Rural Water Association of Utah rep- resents about 350 small water systems in Utah and its mission is to provide professional training, support services, and representation for water and wastewater utility members to help enhance the quality of services to their custonlers. Memorial Day plans underway at Bullfrog Basin, Supt. announces Superintendent Joseph F. Alston announced last week that the National Park Service is again requiring advanced reservations for overnight camping at vehicle accessible beaches in the Upper Bullfrog and Stanton Creek area of Lake Powell over Memorial Day Weekend. This year, camping fees will be collected at Stanton Creek, Upper Bullfrog, Hite, Farley Canyon and Lone Rock Beach. Visitors can expect to pay entrance, camping and boating fees lake wide this year. In 1997, camping and boating fees were implemented doTvrfTake in the Wahweap Marina and Lone Rock area. Thisear the fee program has been expanded to include Lees Ferry, Bullfrog, Halls Crossing and Hite. Fee stations are slated to be opened April 6 down lake (Wahweap and Lees Ferry), and April 24 up lake (Bullfrog, Halls Crossing and Hite). To enter the recreation area for one to seven days, it will cost $5 per vehicle, and $10 per vessel. Season passes are available for $15 per vehicle and $20 per vessel. For individuals entering on foot, bicycle or motorcycle, the price is $3, or $15 for a season pass. Golden Eagle, Golden Access and Golden Age passes will honored. The permit system for the Upper Bullfrog and Stanton Creek beaches has been in place for two years. Prior to the permit system, Memorial Day Weekends at Bullfrog resulted in drawing hundreds of individuals whose primary objective was to come to Bullfrog and party.
