The parking facilities required by this title shall be located on the same lot or parcel of land as the use they are intended to serve except for approved shared parking or payment-in-lie- u of parking. A. Shared parking facilities may be used jointly with parking facilities for other uses when operations are not normally conducted during the same hours, when peak uses or seasonal uses vary, and that shared parking lots be located within 300 feet of all businesses being served by such lots. Requests for shared parking are subject to conditional use approval of the Moab Planning Commission. The minimum conditions includes the following: 1. Proposal must show sufficient evidence that there will be no substantial conflict in the periods of peak demand of uses for which the joint use is proposed; 2. A site plan showing the number and location of proposed parking spaces, locations and size of buildings, parcel boundaries, streets, sidewalks, driveways and curb cuts; 3. A written agreement executed by all parties concerned which shall be filed with the Moab City Recorder. B. In the event that the Zoning Administrator determines that parking cannot be reasonably provided in accordance with the provisions of this title, a commercial property owner may be allowed to make a of providing payment-in-lie- u parking spaces, according to the following conditions: 1. Each person licensed pursuant to this chapter shall pay a quarterly license fee computed on the retail sales of each separate place of business during each calendar quarter of the year. 2. Such fee shall be paid on or before the thirtieth day of the month immediately following the end of such quarter and shall be an amount equal to the total of the following: a. A fee upon every retail sale of tangible personal property made within the City for equivalent to 1.8889 the sales involving the exchange of property, equivalent to 1.8889 of the consideration paid or charged, including the fair market value of the property exchanged at the time and place of the exchange; provided that the fee upon any single item of personal property shall not exceed eighteen dollars and eighty-nin- e cents. b. A fee equivalent to 1.8889 of the amount paid for all meals furnished by any restaurant, hotel, drugstore, club or other place. c. A fee equivalent to 1.8889 of the amount paid for admission to any place of amusement, entertainment or recreation. d. A fee equivalent to 1.8889 of the amount paid or charged for all services for repairs or renovations of tangible personal property, or for installation of tangible personal property rendered in connection with other tangible personal property. e. A fee equivalent to 1.8889 of the amount paid or charged for tourist home-hotemotel or trailer court accommodations and ser- l. vices. f. A fee equivalent to 1.8889 of the amount paid or charged for laundry and dry cleaning services. g. When right to continuous possession or use of any article of tangible personal property is granted under a lease or contract and such transfer of possession would be taxable if any outright sale were made, such lease or contract shall be considered the sale of such article and the fee shall be computed and paid by the vfendor or lessor upon the rentals paid.
