Show THE HERALD, Provo, Utah, Thursday, November Page B2 1, 1330 moves to ban diet drug ingredients FDA Legal ramifications of living together By CHANGING TIMES The Kiplinger Magazine For AP Newsfeatures ;The legal system is struggling to catch up with the times, so there is still little consistency from state to state regarding the legal status of the millions of couples who live together. The law is changing all the time. : Cohabitation is still illegal in a few states including Arizona, Idaho, Mississippi, North Carolina but the laws are and Virginia rarely enforced. The trouble for unmarried couples starts not when they move in together but when the relationship ends. The law doesn't get involved with couples who agree on how to untangle things. But when unmarried partners disagree, the ground rules get complicated. Unofficial relationships are governed by contract law, and disputes may be decided by a jury in civil court rather than by a family court judge. More important, unmarried partners don't have the same rights as spouses to share property or to receive alimony or maintenance payments. That can make a dispute more unpleasant and expensive than a divorce. "You'll have to spend money to develop the relationship and rights that the law already gives married couples," says lawyer Henry Berman, of the law firm Fink Weinberger, in White Plains, N.Y. It could cost the two of you at least $15,000 to take a dispute to court. And depending on the property you're fighting over, the cost may go up from there. There are ways to avoid that kind of pain. At the very least, you can keep careful records of all significant expenditures and purchases you make while you and your partner are together. Keep canceled checks for items : ; you believe you own and make sure all of your property is in your name. To really protect yourself, draw up a written agreement. Before the celebrated California of the other. Many agreements deny rights to assets and income. Which assets each partner owns. List assets, along with their approximate value and the date you acquired them. If you keep Services "palimony" decision in 1976 involving actor Lee Marvin and his live-i- n companion, courts in most states wouldn't enforce a written agreement between unmarried people. Since then numerous cases, involving heterosexual and homosexual couples, have strengthened the use of written agreements in court. And though they can be challenged like any other contract, explicit written promises can protect you. The consequent of not having a written agreement is painful: Most courts refuse to infer an understanding from the actions of the partners. Even oral agreements are difficult to prove. You can work out an agreement on your own or with the help of a mediator or lawyers. Written agreements (LTAs) cover what you believe to be your property or what you should be reimbursed for should you and your partner split up. Ralph Warner and Toni Diara discuss the following points in their book, The Living Together Kit (Nolo Press; $17.35): Whether either partner has rights to the property and income living-- together assets in your name, your partner will have no automatic rights to them unless that is stipulated in the agreement. Many LTAs also specify that all earnings and appreciation on assets belong to the owner. Whose debts are whose. You are not responsible for your partfor ner's debts unless you a loan, for example, or commingle assets or income, making it difficult to determine who owns what. If you have a line of credit or overdraft privileges on a checking account and your partner has access, you are liable, regardless of who uses the services. If the two of you have a joint credit card account, each partner is liable for the entire debt. The quid pro quo for the agreement. Like any contract, an LTA requires something of value on both sides. M. Dee Samuels, a San Francisco family lawyer, says that can be the sharing of any responsibilities. "They don't have to be equal, either," she points out "If you provide home-makeservices and your partner provides the money, mat's OK." co-si- r's such a safety hazard. That ingredient is guar gum, which is extracted from plant matter. Three months ago, FDA told the distributor of one brand of diet tablets that contain guar gum to stop distributing the tablets because it had received 17 reports of users suffering from obstruction of the esophagus. The agency said the 111 ingredients had not been proven effective in diet products. The ban includes alcohol corn syrup, dextrose, kelp, pineapple enzymes, rice polishings, saccharin, salt, sodium bicarbonate, vitamin C and wheat germ. FDA said it had given manufac marriages are in Tuesday's Federal Register along with another proposed riling that calls for a warning on general drugs containing water soluble gums. That, said FDA "is also a result of reports of esophageal obstruction following ingestion of diet and laxative products containing these ingredients." Products containing such sub1 stances, including guar gum, psyl- -' lium, and the like, would have to carry labels warning users to take them with adequate fluid and to avoid them totally if the user had , ever had difficulty swallowing. er Follow your nose to good health w w it had received no significant information. The proposed ban was published diet drug products, including one it says presents which the courts consider prostitution. Spell out what each person will contribute to the household, whether it's money or services. Use percentages or dollar amounts and indicate what they apply to, such as the mortgage or rent, utility bills and household maintenance. How you will take title to assets you acquire while together. You can choose to own property individually, as joint tenants with the right of survivorship, as tenants in common or as a combination of each. You can pass your share of property owned as tenants in common to whomever you want in your will. But joint tenancy property automatically passes to the survivor, so that could cause problems if you split up and you could be making gifts to your partner that are subject to the federal gift tax. The only things that must not be rec- ognized and you do not want to be considered married, say so. (If there's no written agreement, create a document to cover just this point.) Then be careful not to introduce yourselves as husband and wife. How you will divide assets if you separate. Also specify whether either of you will be responsible to the other for future support. What will happen to the home you own together if you separate. Decide whether one of you will continue to live in the house and under what circumstances. But some of the fresh smells found naturally in country air have specific healing powers to clear the head and ease the spirit, according to Country America magazine. These healing powers are called aromatherapy, which is a new name for an ancient healing practice. It's the breathing of fragrances of healthful herbs that lifts our spirits, soothes our minds and relaxes our bodies. Aromatherapy relies on the use of essential plant oils. They are available from natural food and herb stores and farms. They are highly concentrated, so just a few drops at a time are all that's needed. For a clogged nose or a tight chest, try these plant oils as an expectorant: Put a few drops of Much of what ails us is more than just physical. Peptic ulcers, colitis, headaches, muscular pains and high blood pressure are just a few of the ailments that relate directly to our stress level and harried state of mind. The theory behind aromatherapy is that if the mind can be soothed, good health for the whole person will follow. Ever since "Wanda" moved back home a month ago, her lack of modesty has been bothering me. She often lounges around in her bra and panties, or a skimpy teddy, or shell show up in a that isn't quite long enough. It doesn't matter whether her brother is around or not. The other day I came home from shopping and heard the two of them splashing in the pool. A few minutes later I stepped outside to say hello and received the shock of my life. There was Wanda, as naked as the day she was born, lying on her back in a beach chair. Her brother sat a few feet away. They were talking and laughing, totally unconcerned about her nudity. I was stunned but decided not to make a scene. Later that evening, when we were alone, I told Wanda that I was shocked that she would loD around naked in the presence of her brother. She said it's better that he learn what a woman's body looks like at home than satisfy bis curiosity by buying pornographic magazines or getting some young girl to show him. Her reasoning sounded logical, but I am still troubled by the whole thing. Ann, is it harmful to my son to see his sister scantDy clad and node, or is it beneficial to him, as Wanda seems to think? What, if anything, should I do or say? Thanks for your thoughts. D.R., Hartford, Conn. J)car Hart: A ready had ordered something. The enclosed card is an example. The last line says, "This notice should not be interpreted as indicating recipient has placed prior order." To tell you the truth I read it three times and I thought it said, '"This notice SHOULD be interpreted ..." I didn't see the word "not."
