"We will hear that the Texas prison system is probably one of the best." Justice Department lawyer David Vanderhoof said in opening remarks. "It is the biggest. It ranks first in constitutional deprivations." Assistant Texas Attorney General Ed Idar Jr., said Texas prison officials were "doing the best they can under very difficult conditions that are not getting better. "We are going to hear a lot of horror stories," Idar said. "A few isolated instances where some individual has gone wrong does not establish that it is condoned system wide. Youth Ex-Ar- Private Files Hefty Suit my - ASHINGTON (UPI) James R. Thornwell says that 17 years ago he unwittingly was used as a guinea pig for an LSD experiment by the Army. Now the former private is suing the U.S. government for $10 million. Thornwell filed suit Monday, claiming the Army gave him LSD without his knowlege or permission and tortured him as part of "Operation Third Chance," a secret Army project studying the use of LSD as an interrogation aid. The case is in U.S. District Court, before Judge John Sirica. LSD is a halucinogenic drug made illegal in the 1960 s. Thornwell, who is unemployed and lives in California, said in a statement the drug left him a "social and emotional cripple whose psychiatric would cost you $60,000 in Oskaloosa costs you only $40,000 here," the mayor said. "That's nice, Delmar," the clerk said. "But what about our sidewalks. We can't very well make the busines- smen here repair their sidewalks because the city can't afford to fix its own sidewalks." The suit says Thornwell did not find out about the LSD test until 1977, when he received Army documents through the Freedom of Information Act, detailing the experiments. He sought the documents after being informed by the Internal Revenue Service that his address had been given to the Army so they could perform follow-utests. The Privacy Act forced IRS to reveal to Thornwell that his address had been furnished. p Thornwell, a black, said he was the only American used in the testing program. The suit said the only other persons involved were foriegn nationals. The suit also alleges that for months before the drug was administered in June 1961. Thornwell was subjected to "severe forms of physical and sensory deprivation as well as beating and verbal abuse," including racial slurs. The suit also said he was not allowed to sleep, eat or drink for long periods of time, was given no toilet facilities, was interrogated for periods of up to 70 : hours, injected with sodium pentathol, was hypnotized and was "physically abused and terrified with threats of further injury and death. Such threats were dramatized by a simulated shooting." The test interrogation climaxed, the suit said, when Thornwell was given LSD between June 8 and June 12 and experienced "extraordinarily severe physical and psychological trauma when the LSD took effet" But he was again interrogated by the same "inhumane techniques," the suit charged. After the test was completed the officials in charge "failed even to inform Thornwell that he had received LSD or to alert him of the need for follow-u- p care."
