Show WEDNESDAY, MARCH 28, 1962 Utah County, Utah On Advice of Legal Counsel Car Crashes Into Pole, Driver Escapes Injuries DAILY HERALD Provo School Board To Proceed With Leeway Fund Program, Despite Court Suit Challenge Proyo's Board of Education, is proceeding with plans to implement its district program as it feels the people authorized it to do when they gave a majority vote in favor of additional operational funds. It is not waiting for the outcome of the present court suit instigated against it and challenging j the validity of : the election. This was revealed today in a statement issued by Dr. J. C. Moffitt, superintendent, - speaking - is Peay, a Provo taxpayer, who a member of the Utah Coun- ty Farm Bureau committee on taxation and education. Don Al- len, Vineyard, president of the County Farm Bureau, told the Herald soon after the suit filed that , it was instituted and supported by his organiza- ne xaim uon. uieiu uyeuiy opposed both the Provo and Al-pine leeway elections, not on the grounds that the schools did not need more money, but 'on the grounds that the property tax base was already overloaded and it should not come by raising property taxes. The election lost heavily in the Alpine pistrict. on behalf of thej board of education. Asked what the board would do if it ultimately lost the suit, Dr. Moffitt replied: "That's a bridge we'll have to cross when we come to it." Legal Advice . Dr. Moffitt said the board has been advised by ;its legal counsel that it has every right to proceed as planned with the program authorized j by the election. "You cannot operate a school system on a day-to-dbasis," said the superintendent. "You must plan ahead, and that is what we feel we must do. We have ordered more textbooks and supplies, as we said we would do if the election passed. We will proceed with the hiring of more personnel, principally in the field of counseling, as we also said we would do." Details Spelled Out Dr. Moffitt pointed out that in a series of four signed articles in The Daily Herald prior to the election, he spelled out in detail both the need for the additional money, how thej board planned to spend it, and that it would plainly cost the people a tax levy increase of nearly six mills, which would raise about $145,000 annually. He declared, therefore, that people were given a full opportunity to know all these details. Lynn As ay, UVS driver training instructor, told how youthful first offenders are instructed by the court to take the drivers' course and told how the course is con- ducted. One of the gripes of the young people, the sepaker said, is that it appears to them adults often "get by' with offenses young people are given tickets for. "In that respect, we should be more careful " to set a good example," said Mr. Asay, "and at the same time we would be increasing the safety factor in our . own driv1000 e- - ing." In all the tests given in the course the students grade each other and most of the tests are on skills and attitudes with the latter playing an part in the course. Eyes are tested to' a considerable extent during the course, Mr. Asay said, and, whereas the average of high school age youth with eye defects is only 15 per cent, 70 per cent of the students who have had a traffic ticket have eye defects of some kind.
