THE KIESEL CASE The case of the People vs. Julius Kiesel is not jet decided. Before the sentence was pronounced by the Court the jury having fixed th penalty at ten years imprisonment a writ of habeas corpus was obtained and the prisoner was taken before Judge McKcan in chambers, at Salt Lake. Ilis discharge was demanded on the ground that the Probate Court has no criminal jurisdiction, and his counsel worked themselves up into the regions of "highfulutin," beyond the purview of law and the sphere of common sense, and wanted the officials of the Probate Court arrested. Judge McKean decided that the conviction be set aside, on the ground argaedby counsel,' and held the prisoner under bonds of 1,500 SJEbr trial before the Distriefc Court, intimating his willingness to take against thn Probate Court officials, if the way to do it eould be pointed out, and stating that the committed Kiesel magistrate wh en the preliminary examination, cHould have bound him to appear before the District Court and not the Probate Court.
