Mingo oommenced backing up to Delmonico's; I kept following him up and told him to go away and have no fuss. I still kept following, and he told me to keep back, that he bad nothing against me. I still kept following him up until I got in front of Zachart's; with that Mathew Eenney walked eff the plat form between me and Mingo, got in front ef Mingo, threw up his hands and said, "Keep your shirt on, and don' make any trouble." Then Mingo says to Kenney, "Keep back, I don't want do with you. Don't follow nothing-tme up any further, or I'll shoot." With that he fired. After he had fired he drop ped his hand to his side and cocked his again; with that he told me not to follow him up or he would shoot rae dead in my tracks; with that I turn ed round toward Kenney, and1 I says, 'Mat, you're a goner."
