Show Declares U. S. He scouted Mike Jennie Scardino shot theory that Termain in Interest arose to a high pitch during the argument when Mr. Evans pointed but to the jurors that if Termain was shot by, Jennie Scardino, while In a Standing position, the bullets would have been found imbedded in; the wall. He pointed out that the bullet holes went completely through the body and that one bullet hole' and a depression in the floor where Termain's body was found, showed that the lad was. killed while lying on the floor. District Attorney Eyans also maintained that the story told by Jennie Termain, sister of the dead man, was true and that no amount of gruelling questioning could shake the story. Jennie had testified that the .Scardinos' plotted' to kill her brother, and the shots were fired while he was on the floor. , Mr. Evans also pointed out portions fn the story of Jennie Scardino, who said she shot Termain in as being unlikely. He also called attention to the fact that a bullet fell from Termain's clothing when he was taken to the undertaking parlor. He contended that this made apparent the shot was fired while Termain was on the floor and the bullet flattened by striking the boards and stuck to his clothing.
