PENROSE, OCtDILV, Editor. UTAH. Saturday Morning Oct. 14,1871. Notick. Mr. Edwin Stratford,;of Providence, ii our authorized tgent to transact businesa for the Ji'sctios in Cache Count. The Crusade Continued. Tbe decision of Judge McKean on tbe motion to quash ' the indictment in tbe ease of "The people tersus Brigham Young," was not delirercd until Tuurn Honor day last. Aa was expected, Hi overruled tbe motion, his argument that if be quashed the indictment on the grounds presented bjr counsel for the defence, the Grand Jury would be In duty bound to find sixteen new in dictments, and that if he should compel tbe prosecution to elect one oount on which to go to trial, the Grand Jury would be iu duly bound to find fifteen new indictments, which would be more 'harassing ami vexatious" to the defendant than the consolidation of the sixteen counts in one indictment. His Honor, in the concluding remarks f bis "Opinion," made the following extraordinary statement: It is therefore proper to say, that while tbe cma at bar is culled, "The People vcrttu Brigham Young," its other and real title is. Federal Authority versus The governTheocracy. Polygamic ment of the United States, founded upon a wriiten constitution, finds within its jurisdiction another government, claiming to oome from God imptrium in impe-ri- o whoso foliey and practices are, in grave particulars, at variance with its own. The one government arrests the other, in tbe person of its chief, and arraigns it at this bar. A system is on trial in tho person of Brigham Young. Let all concerned keep this fact steadily in view; and lot that government rule without a rival which shall prove to be In the right. Here is a plain declaration from the Judge that the present prosecution is merely a feeler. IIo brings the government of the United Slates into antagonism with the system in Utah represented by Brigham Young. The system represented by that great man is to all intents and purposes a religious system, agaiust which tbe government should kave no warfare, with which it has, constitutionally, nothing whatever to do. But the present indictment is framed under a Territorial Statute, not under any law of Congress. Neither polygamy fcor theocracy is called in question. The Act under which tbe prosecution is instituted says, "If any man or woman, not Cefng married to each other, lewdly nd'Jtselviotisly aisooiate and cohabit man practices potogether, etc,'' If whom he cowomen with tbe lygamy, habits are Lis wive; and this aot does not apply to his case. Lascivious co habitation between persons not married Is not polygamy. Theocracy is not alluded to or hinted at in any sense, in I he Statute referred to. ,!Yho authorises Judge McKean to state that tbe Government of the United 8tates is on trial as well as and in opposition to Brigham 'Young? Is McKean, C. J., the United States? Oh, how little toads do swell! But this statement "clearly shows the object of the Salt Lake "ring," vix., to bring about, if possible, a collision between the people of Utah and the Government, but which object will be defeated, as the plotters will find to their shame and confusion. Tiie trial of Pre9t. Brigham Young will now proceed, anil it la to be hoped that his counsel will demand that there bo no delay? Tbe. prosecution should "always be ready" and the defendant ought not to be harassed by the shadow of an indictment hanging over him from day to day. Let the issue eome. Let the farce proceed. We are anxious to see the real play prepared behind the be-in- ?, Utah to the Keeue. Ci. At the Mass meeting in ai l of the Chicago sufferers held on Wednesday at the Old Tabernacle, Salt Lake City, Prest. Brigham Young headed the subscription with $1,000. The sum of $ti,285 was raised on the spot. A committee was appointed to receive contributions, and it is expected Salt Lake will donate about $l,&00, which will compare favorably with tbe amounts from the great eastern cities all things consid ered. Yesterday, by proclamotion ot the May or of this city, a mass meeting was called, to meet at the Ogden Tabernacle, at 1 p. m. As only a few responded to the call, the meeting adjourned until 7 p. m., when a committee was appointed to re ceive subscriptions in aid of tbe sufferers by the Chicago calamity. Of course it cannot be expected that Ogden will compete with large and rich to the recities in contributing lief of the burnt out people of Chicago, but It can do its part. So can tbe residents of other pluces in Weber County. If all will do a little, quite a respectable sum can be raised. Cash is rather scarce in this part of the world, but grain is plentiful. The U. P. Company, a car of doubtless would "dead-head- " to of the and either other Omaha, grain lines would forward it to Chicago, and the grain could be donated just as well as not. From among the many comments of the press on tbe situation in Utah we se lect the following from tbe San Francisco Examiner because it strikes the nail squarely on the head, and shows that the writer understands the aim and ob ject of the needy gang who are stirring up strife in this Territory in the hope, like the roughs in the Chicago conflagration of being able to grab, something rich while the fire is burning: The Union comes to the defense of Brigham Young. We do not know but that this once it is right. It says: "These Mormons went to a distant region, us our forefathers fled from Engluud, and founded institutions of their own. Tney went where no State laws were mude to extend, and the constitution of the United Slates and laws made in accordance therewith have not in the past iu terfered with the family relation. Marriage is not one ot tbe institutions the sovereignly of the United States takes cognizance of, and the declaration that the common law steps in, in tho absence of anything else, and makes the polygamic amenable, is mado in ignorance of the fact that the United States knows no common law, and it cannot be recognized anywhere except by statute. Up to a very recent period, the Mormons having full sway iu Utah, no laws existed that militated against their peculiar institutions, but were in consonance with them. 'Where no law are no offense abounds.' An act ot lute date cunnot go back of its enactment to punish. Ex pott facto laws are prohibited, and we conceive that any act of congress or of the Territorial legislature cannot punish polygamy practiced' before the enactment." Perhaps, if the Union understood the motives which prompt this crusade against Brigham and other leading Mormons it would not be so liberal. The whole thing is instigated by a "ring" of Republican politicians, who are looking to the speedy admission of Utah as one of the States of the Union. These small-frpopinjay politicians and would-bstatesmen know full well that they will have no show for promotion until the Mormon power is broken. Hence it is that they seek to ereate a civil war by means of packed juries, unprincipled Of judges and perjuror- - witnesses. course,' ff they determine tbitio Mormon shall sit on a jury to try Young, as all were excluded from the grand jury, he will necessarily be convicted. Having the judge and marshal they can pack a jury to suit themselves. If they can send Brigham to prison, and induce the people to rise np and liberate him, and thus produce a conflict, Utah will be at once admitted as a State, and under the protection of Federal bayonets, these mischief-maker- s ouu have themselves elected senators, congressmen, etc, did just as the thieving carpet-bagger- s ai the South. The whole affair is a disgrace to the American name. That a vile little clique of corrupt politicians should be permitted to use tho power of the government to embroil a peaceable community in civil strife to gratify their personal greed for plaue and plunder is an eutrage upon decency, humanity and justice. y, e nt LOOK! night the American of and other similar vations which are as much opposed to their theory of marriage as the ' Mormon" system. Most people know perfectly well that the moral motives thrust forward by that party as a reason for (heir attacks, are the veriest sham, and the most transparent pretense. The secret is this: Tbe platform of the party, as constructed at tbe now prostrate city of Chicago, was the destruction of the "twin relics" slavery and polygamy. Over the ruins of slavery, Gen. Grant rode into power on the expiration of the last presidential term, and the party he has represented were nationally popular for a time. But a change has taken place in public opinion, and the centralixing and rabid policy of the Radioals has produced great and increasing dissatisfaction. Something has to be done to revive popular favor, and it is supposed that the accomplishment of the unfinished portion of the party's programme will give them the victory in '72. Political expediency, not morality, is the motive power of the blast against polygamy. But the Radicals have made ablunder. The great people of the country are better informed on the "Mormou" quee-tio- n than in former times. Tbe inteli-geportion of the community have no wish to see the State interfere with any religion, no matter how opposed it may be to their prejudices and convictions. They begin to grasp the fact that marriage is with the "Mormons" a religious question and consequently Congress has no right to touch it. This raid against a peaceable, industrious oommunity will not be so popular as expected. It is a fact that every leading politician who has lifted his band or raised his voice against this people, has become politically bankrupt. What is true of persons, will hold good with parties. Cannot the Radicals take warning by the past? We suppose not.
