Mm .1 t Compliment, Barb Dear Editor, One must compliment Mr. Richard Coles for his actions in sparking some interest in forming a Midvale City Arts Council. I believe, with his concern and help, that it will become a reality. However, I would like to express great concern over the suggestion in Midvale City's council meeting last Tuesday night that a director of such an arts council should find himself on the city payroll. This position should be reserved for those who will give of their service at no cost to the people of Midvale. If the city has funds then let's spend them on the sidewalk repairs on the avenues, to help the elderly at their center, or in cleaning up the city. These are just a few of the many needs of the city right now. An important part of being a member of this city is the opportunity to serve. To pay someone puts the whole idea in the hands of the politicians - after all, they sign the check. We need more people involved in our city, not less. BE IT ORDAINED BY THE MURRAY CITY MUNICIPAL COUNCIL, MURRAY CITY, UTAH, AS FOLLOWS: SECTION I 5 of the That Section Murray City Code pertaining to fireworks be amended to read as follows: Section Certain Fireworks Prohibited. A. As used in this section : (1) "Firework" means any or device composition manufactured or used for the purpose of producing a visible or audible effect by combustion, deflagration, or detonation but does not include model rockets, toy pistol caps, emergency signal flares, snakes or glow worms, party poppers, wire sparklers under 36 inches in length, matches, or class A and B explosives. (2) "Ground or hand held sparkling" device means: a Any cylindrical tube (cylindrical fountain) not exin inside diameter ceeding and containing not more than 75 grams of pyrotechnic comwhich produces a position shower of color and sparks upon ignition and may whistle or pop; lb) Any cardboard or heavy paper cone (cone fountain) containing up to 50 grams of pyrotechnic composition which produces a shower of color and sparks upon ignition and may whistle or pop; ic) Any cylindrical tube (illuminating torch) containing up to 100 grams of V pyrotechnic which produces upon ignition; composition colored fire (d) Any pyrotechnic device (wheel) capable of being attached to a post or tree containing up to six "driver" units or tubes not exceeding in inside diameter that each contains not more than 60 grams of pyrotechnic composition per driver unit which revolves upon ignition producing a shower of color and sparks and sometimes a whistling effect; (e) Any device similar in design and effect to a "wheel" capable of being placed on the ground (ground spinner) and ignited; and (f) Any narrow paper fuseless tube (flitter sparkler) filled with pyrotechnic composition that produces color and sparks when the popper at one end of the tube is ignited. V (3) "Ground audible device" means any paper or cardboard tube containing not more than 50 milligrams of pyrotechnic material that travels along the ground (chaser) upon ignition and often produces a whistling andor popping effect. : (4) "Combination fireworks devlce"means any device containing combinations of two or more of the effects described In subsections (2) or (3). (5) "Trick noisemaker" means: (a) Any tube or sphere containing pyrotechnic composition that upon ignition produces white or colored smoke (smoke device) as its primary effect; and (b) Any device that produces a small report Intended to surprise the user, including: (I) A "booby trap" which Is a small tube with a string protruding from both ends that Ignites the friction sensitive composition in the tube when the string is pulled; (II) A "snapper" which Is d a small device containing a minute quantity of explosive composition coated on bits of sand which explodes producing a small report; (III) A "trick match" which is a kitchen or book match coated with a small quantity of explosive or pyrotechnic composition that produces a small shower of sparks when ignited; (IV) A "cigarette load" which Is a small wooden peg coated with a small quantity of explosive composition that a report when Sroduces small is ignited and An "auto burglar (V) alarm" which is a tube which contains pyrotechnic composition that produces a loud whistle and smoke when ignited. A small quantity of explosive, not exceeding 50 milligrams, may also be used to produce a small report. A squib it used to ignite the device. b. The City Council here voted 1 in favor of submitting the names of City Manager Ron Olson and Mayor pro tern Sherm Monson to the governor for a three-yea- r appointment to the board of directors of the County Water Conservancy District. Provisions of the Water Conservancy Act require tljat the city submit two nominations for a district vacancy. Olsen's term will expire on May 20. Councilwoman Betty Naylor had lobbied council members for their support in also submitting her name. Naylor cited her experience serving on other water-relate- d committees that would compliment the appointment. She was asking the council to submit the names of two elected officials instead of one, noting that it is elected officials who are responsible to the community. Naylor said she did not feel the provisions of the act precluded the possibility of submitting three names instead of two. Other council members disagreed, voting to submit the names of Olson and Monson instead. unlawful for any person under the age of sixteen years to purchase or discharge fireworks which are otherwise lawful under this section. c. Any person who sells at retail fireworks other than those listed in section a2) through (5) above is guilty of a class B misdemeanor. h. Any person holding a proper business permit to sell fireworks pursuant to this section shall conform to the following requirements(1) The Fire Chief of the determine or regulate the location of fire works sales so long as such regulations do not violate any provision of this chapter or Section et seq.. U.C A., 1953. as amended. ( Rev. 485) (2) No person shall engage in any type of retail, class "C" fireworks sales, storage or handling without' first having submitted an application for and obtained a business permit for sale of fireworks from the City. Annual fees for issuance of such permit shall be $350.00 Such permit shall be issued for one calendar year and shall be subject to all other ordinances relating to business licensing not incompatible herewith. (Rev. 4851 (3) Persons selling fireworks shall be 18 years of age or older. A salesperson shall remain at the sales location at all times when open to the public unless suitable locking devices are provided to prevent unauthorized access to the merchandises by others, or unless the merchandise is removed. (Rev. 485) (4) Each perm i tee shall be required to have in force and to show proof of personal and property and public liability insurance in the amount of $100,000$300,000 setting forth the city as a named insured. (5 All retail sales locations shall be equipped with fire fighting equipment; extinguishers with a combined rating of at least 2A:10-B:shall be used (Rev. 485) (6) Fireworks shall be stored, handled, displayed, and sold only as packaged units Broken packages shall be removed immediately upon discovery of the broken package. (7) Outdoor Stands: In addition to the regulations and standards set forth in this Chapter, the following standards are established for outdoor retail sales: (7.01) In all outdoor retail sales locations, the area where fireworks are displayed or stored shall be at least 50 feet from any device which dispenses flammable liquid or gas. or other highly combustible material. (7.04) All outdoor retail sales locations shall be at least 100 feet from any church, health care institution, or outdoor retail school building. (7.05) Smoking shall not be permitted within 50 feet of any fireworks, either on display for retail sale or being stored. "Smoking prohibited within 50 feet" signs (in letters not less than 4 inches high) shall be conspicuously posted. (7.06) The size of the stand shall be limited to a maximum of 200 square feet with no dimension exceeding 24 feet. (7.07) Each stand shall have a minimum of two, 3 0" wide X 6'8" high, exit doors, which swing out at opposite ends of the stand. Door locking devices, if any, shall be easily released from the inside without special knowledge, key, or effort. (7.08) Each stand shall have a minimum 3' wide unobstructed aisle, running the length of the stand, inside and behind the counter. (7.09) The pass through openings for sales of fireworks in stands shall be arranged to permit the customer to view the merchandise for sale but prevent the touching or handlby the ing of fireworks customer. (7.10) Temporary stands for the sale of fireworks shall be located In properly zoned areas, at least 10 feet from other existing permanent buildings or vehicles, 100 feet from other fireworks stands, 50 feet from flammable liquid or gas storage and dispensing units, and 20 feet from a public street, sidewalk or property line. (Rev. 485) (7.11) If the stand is used for the overnight storage of fireworks, it shall be equipped with suitable locking devices to prevent unauthorized entry. (7.12) Stands shall not be illuminated or heated. No stand shall be furnished with temporary power or other electrical service unless approved by the appropriate power department electrical inspector. (Rev. 485) (7.13) Fireworks sales stands shall not be put on site more than five days prior to, and shall be removed within' five days after the period permitted for sales. (7.14) No person shall occupy a fireworks sales stand after hours of operation. (8.02) In all retail sales locations in permanent struc- tures, the area where fireworks are displayed or stored shall be at least 50 feet from any flammable liquid or gas, or other highly combustible material. Fireworks shall not be stored (including stock for sale) near exit doorways, stairways, or in locations that would impede egress. Stock not displayed for retail sales shall be stored in accordance with the provisions of Chapter 44A of the National Fire Code, 1980 Edition, pertaining to Fireworks. I. Police officers here are continuing their investigation into a rather bizarre case of aggravated assault that took place early Monday afternoon. At about 1:30 p.m. officers responded to a call from a man who reported that he had been threatened with a gun. The victim stated that he had been driving west on 7200 South near 200 West when he noticed a car pull up along side. Then he saw a man on the passenger side bring a gun up to the open window and point it at him. The victim hurridly pulled over to the right, allowing the other car to pass by. He then followed it onto heading north. The victim said later that he flagged down a Highway Patrolman near 4500 South. The patrolman put out a bulletin on the suspect vehicle and advised the vic tim to report the incident to the local police. The car was described as a late 70's model faded red in color with a white vinyl top. The victim was unable to get the license plate number. The description of the suspect is as follows: a white male in his early thirties with short black hair and brown eyes, wearing a d white shirt; he had a mustache. long-sleeve- Police and arson investigators are continuing to look into a fire that gutted the interior of stolen Jeep discovered Sunday near 111 So. Allen St. Fire fighters were called to the scene and quickly knocked down the flames. According to Det. The snow courses around the Salt Lake Valley range from 125 percent of average at Snowbird to 93 percent of average at Trial Lake, reports Max Phillips, Soil Conservation Service, Midvale. on April 1. In early September 1982 it was 4200. In 1963 the elevation was at its all time low of 4191.35. The lake will rise this Spring. The question is how much and for how long. At elevation 4190 the lake covered about 575,000 acres. At elevation 4200, about 1,060,000 acres. And at 4210 it will have a surface area of about 1,500,000 acres. Snowbird has the heaviest snowpack by far with 110 inches of snow containing 44 inches of water for 125 percent of average. Last year this course was 133 percent of average. Parleys Canyon summit "That's a tremendous evaporative area," commented Phillips. "Now if Mother Nature will cooperate with some moderately dry weather this with 66 inches of snow and 20.7 inches of water content is 110 percent of average.
