I Daly-Judg- BOGUS CHECK IN 0 UESTION &- Rocco-Homesta- G. E. Rice, Charged With Forgery, Swears That Paper Is Genuine. hearing of G. E. like, charged with having forged the name of S. W. Darling, a cattleman, to a check for $1500, was begur. in Judge Diehl's court this morning, and at noon adjourned until 3 o'clock this afternoon. J. W. Telford swore that he could not say that he knew Rice's true name. Rice had worked for him for a couple of weeks as a roulette dealer. He knew him as George. Rice had told him that he. Rice, had seen the check drawn, and that it was a good check. He met Rice and Darling together the day before Mice's arrest, while each of the men had asserted that they had never seen each other before the arrest. George W. Morgan swore that he had the check cashed at the bank, and sent Telford word to that effect, after which Telford went to him and got the 51500. S. W. Darling, the complaining witness, answered one question on direct examination. He said that he had not written the check in question. he said that he On came to the city on September 22, 1904, and remained for only a few days. The only stranger he met while here was a man named Brady. On request of the. attorneys for the defense he wrote his signature a number of times, and then the words written on the check in question. He said that he would not forget such an incident as writing a check for $1500. The State rested its case and G. E. Rico, the defendant, was called by his the attorneys. He said thatv he sawwrote (,heck written and that Darling it. Some time later White, a friend, ;isked him to get it cashed, which he did. bavins Telford cash it. He said he told Telford that the check wa? genuine. Telford asked him who White was, and Rice vouched lor White. Rice said that he went to White's on loom in the Antler rooming-hous- e sat behind and 23rd, Darling, September who was sitting in a poker game. White was dealing.
