Show I THURSDAY EVENING, NOVEMBER THE SALT LAKE TELEGRAM. 12, 1903. OUNCIL DECIDES THAT TV4 COOKS AND WAITERS Against His Belief in Sustaining Fernstrom's Point of Order. : The City Council, fitting as a canvassing board, decided last night that the Democratic candidate for Councilman for the short term in the Second precinct had received a plurality of 11 votes and is accordingly entitled to a seat in the Council for two years. Tuesday night Councilman A. J. Da- -' vis gave notice that he would ask for a reconsideration of the tally sheet for the Fifteenth district of the Second prescind, and accordingly moved to that end last night. His motion also specified that the judges rf election for that district be permitted to state whether Burbidge should have 82 votes as shown on the tally sheet, or but 72 as t'.ie're- turns showed. Councilman Black seconded the motion. Attorney 1 ram el. counsel for Burbidge, was permitted, prior to the of the moUon, to fiie a protest in the Council against a reconsideration of the matter. The protest was signed by Bramel as attorney for Burbridge, Ben D. Luce, chairman of the Democratic Second ward committee, and J. C. Leary, chalr-- " man of the Democratic city committee. They protested against the introduction of any evidence or any documents that might modify or alter the returns of any of the djstr.'cts. They protested against the changing of the vote as shown on the face of the returns or of , substituting any document in lieu of , them. And in regard to the Fifteenth district said: "This protest is made with particular reference to the election matters pending before your body as between George S. Burbridge and George D. . in the Second precinct of said city,Dean, and applies vitb, particular reference In regard to your proceedings touching district Fifteen of said precinct." Fern?trom Lays Down Law. The protest was rt&d in full, and Councilman Fernstrom from the Third was given the iioor and said that he had conferred with a number of attorneys and that the Council could act in no other way than approve the return as made by the judges of election. . President Cottrell declared the of order well taken but said thatpoint the chair believed that 72 iistead of 82 votes for Burbridge was correct. ' Councilman A. J. Davis then appealed from the decision o? the chair, and Black, Vigus and Robinson stood by him, while Hewlett, Sharp, Sper.ce1 and Kardiey voted with the Democrats, Arnold, E. H. Davis,' Fernstrom ard Tud-- r denham.
