NAMEB BY COMPTROLLER i Attorney Nye Pleads ExUR BABIES tenuation, but Judge Stewart Imposes Limit AT ONE TIME of Penalty as Provided Colored Woman in Ohio by Statute. F0 Because Maurice Steifel talked to several jurors in the case of Jane Rocca against the Utah Savings and Trust company, the case pending at the time of the conversation, Judge Samuel W. Stewart this morning adjudged him guilty of contempt of court and ordered that he ray a fine of $200 or in lieu thereof be confined in the county jail for an equal number of days. Listened to Affidavit. The ca?e was called shortly after court resumed its session this morning. Steifel was on hand and after taking the witness stand listened to the reading of the affidavits filed yesterday by Jurors Hampton and Knight. City Attorney Nye representing him asked that he be sworn before answering these affidavits, but the court deemed his former oath sufficient to guarantee truthfulness. Attorney Nye questioned Steifel, who gave the follow ing information: of Mother Becomes ().. Oct. 21. Swuggtstion made that I had better mt talk any more on that subject, and wp immediately began talking politics. u : t-- t t .J e-- had said something about the evidence offered by Mrs. Jones, but could remember nothing definite, so in order that T might k;ep posted with the proceedings of the case I told Mr. McCarrick that I wanted to know some facts of the case, wishing to find out concerning the testimony of Mrs. Jones. McCarrick lives only about half a block distant from my home. I did not discuss the case with him or make any attempt to do any dissuading. He stated that during the afternoon something of a nature having a bearing on the case came up in Page's brokerage office and that he .stated to those talking of the matter that as he was a juror in the case he would be obliged to leave the rcom unless the:- desisted. Denies McCarrick's Statement. "I paid: 'Very well,' and as I was poing out the door I did not turn and make the statement that prior to that time I had talked with other jurors, as McCarrick alleges in his affidavit." Judge Stewart asked if Steifel was at the time he admonpresent in court ished the jun--, to which the young man replied that he was not. Juror McCarrick was next called to the witness stand. lie stated that in the face of the denials made by Steifel he. had nothing further to say. In Defense of Steifel. Attorney Nye here spoke in behalf of his client substantially as follows: "It sons to me, if your Honor pleases, that while it is clear my client acted in muh the same manner as is allege-- ! in the affidavits, the attempt was not wil'ful or vicious, and from the fact that he has never served as a Jjror and that he has frankly told the court of the conversation, his actions may be attributed to his interest in the outcome of the case. Not realizing that he was committing on offense, the judgment of the court, I think, ought to be entered with consideration and mercy.
