PERM TIED TO MAKE A CON MERCUR TUMBLES; SP EECH TO THE COURT OTHER STOCKS FIRM The passing resentence upon Peter not for several yet. of Mortensen, the convicted murderer of James R. Hay, which was to have taken place at 10 o'clock this morning, was postponed until 2 o'clock this afternoon, at which time Attorney Bernard J. Stewart for the defense will present to Judge Morse letters which are alleged to have been received from a party closely connected with the case, who it is said is able to make an affidavit to the effect that all the evidence in the case was not brought out at the trial. Long before the time for the courtroom to open this morning the adjoining corridors were black with people intent on seeing the defendant, and after the doors were thrown open the people came in a steady strer.m, tilling' the room completely. Mortensen was brought down from the penitentiary by Acting Warden "Wright and Guard Andrew Ure, and was taken to the Sheriff's office where he remained, handcuffed and well guarded, until 9:50 o'clock, when in company with l is prison keepers, Sheriff Emery ana five deputy sheriffs, he went into the courtroom. As. he placed his hat upon the rack the handcuffs were removed and the defendant took a seat on the criminal bench between his two keepers. From all appearances he is little the worse for his long imprisonment, and the only perceptible change is a more taciturn expression and a deeper scowl upon his forehead. His mustache has grown long, as has also his hair, which was carefully arranged. He vvas dressed in a black suit with white collar, cuffs and necktie. Shortly after his entrance B. J. Stewart, attorney for defense, came in the courtroom, and advancing to where Mortensen was sitting held out his hand. Mortensen arose from his seat, smiled and grasped and shook the out stretched hand warmly. Court was called promptly at 10 o'clock and after a few minor matters were disposed of the case of the State of Utah vs. Peter Mortensen was called. Attorney Stewart arose, and in substance said: "If the court please: I have filed a motion for a new trial for the defendant in this case, which is supported by an affidavit made by Alma H. Rock, one of the jurors, to the effect that the Jurors did not conduct themselves propwas erly, that all the evidence foundconsenot introduced in the trial, and was newly discovered evidence. quently 1 therefor ask your Honor to suspend sentence until this motion is disposed of. As the crowd slowly dispersed Mortensen alled District Attorney Eichnor to his side and said that he wished permission to address asthehe court, and wished to, make is long a speech and did not want the prosecuting attorney to object to his speaking.
