He has symbolized modern Mexico. In our desperate sparring with Russia for the minds of men what greater calamity except open warfare could have befallen us than if Mexico had become a Communist state? Our nations share a 2,000 mile border, all of which would have had to be fortified. The fine airfield at Monterrey, familiar to Americans who fly between the countries, would be a big bomber base in all probability, and oil course there would be no tourists going back and forth. How. would the majdV lifeline of our airpower production, stretching from Los Angeles to Seattle, and our chief Plutonium plant not far away.' feel about the presence of Russian-mad- e bombers in Just over the California-lowe- r California border? Could we have maintained our casual defense of and thus money-savin- g the Panama Canal since J Day if there were hostile bombers in Vera Cruz or Yucatan? What about the security of our plant at Fort Worth and other industrial and population centers along the soft underbelly of the U. Using the same reasoning, it would appear virtually impossible for a candidate from outside the heavy population perimeter of Utah, Salt Lake and Weber Counties to be elected that is, unless he was already exceedingly prominent in public life or matched against a candidate from another small county an unlikely situation. Regardless of to how good his qualifications, a candidate little-know- n chance small would have belt in the heavy population voters to win. 4. The separate ballot system provided under the new law mskes voting more complicated and confuses many voters. Despite broad publicity on the new plan, thousands of Utah voters did not vote the judicial ballot, apparently because they did not fully understand the matter. In Utah County alone, there were nearly 6000 less ballots cast for Henriod and Jeppson than for candidates in some oi tne other contests; and the vote for Wade and Worthen was 4000 under the previaling total of ballots cast. We believe the voting procedure should be as simple as it can possibly law is continued on the be made. Even if the serious us books. :t seems to that study should be given to on the same ballot contests the a plan cf including judicial as the party contests. Space could be provided on the main ballot, as is done in some other states, for the judicial con test so that the names would not appear under the party emblems. Besides simplifying the voting, such a step would have an advantage in that it would cut the cost of printing the ballots. judicial One contention backers .of the election law .advanced was that it would prevent a good, justice from being thrown out of office with a landhiide for the other political party. That point, we believe, is well taken as far as it goes, but it overlooks the fact that other good, qualified men might be denied the n office publically, live outthey are not side the heavy population area, or may. have insufficient financial backing to wage their own campaign without the support of a political party. Referring again to the question of true we think the bar association, itself, which fostered the new bill, showed a type of partisanship ift making public the results of a referendum poll it conducted among its members In August. The poll, made through the mail, gave each member of the bar the opportunity to express his preference of the candidate on the primary election ballot. The 68 per cent of the bar members who returned their ballots favored the twu incumbents. Wade and Henriod. The principal complaint in the past seems to have been that in some years candidates a bit short on qualifications have managed to get on the ticket. . This problem, it would appear, could be remedied by raising the salary of supreme court justices. There are many good Utah lawyera who just couldn't afford to accept a supreme court position for the $7200 it pays. A higher salary would insara competent candidates en both tickets. This In- - ar .With the furor of the lection now over, it is time for an appraisal of Utah's new law providing for the "non-par- ti san' ejection of state supreme court justices. The law, passed at the last regular session of the Utah was put into practice for the first time in the recent elections. A separate ballot was used for the two su preme court contests, in which the two incumbents Jus tices Lester A. Wade and F. Henri Heoriod won voter ap and four-yeterms, respectively. Mr proval for Mr. Henriod was elected to fill the Wade waa unexpired terra of George Latimer, who resigned. Prior to the election he had been filling the post under a temporary appointment from the governor. Without question, the initiators of the new law chiefly the Utah Bar Association had the highest of intentions. Their main objective was to take the selection of the su rreme court justices out of "politics" insofar as possible. But with the experience of an election back of us, we doubt that the law, as now set up, really constitutes progress. We doubt if it is working out as its promoters planned. We believe its disadvantages outweigh its advantages. Here are some conclusions concerning the new procedure which we have drawn after observing the law in its first test, analyzing the election returns, and talking with threats. tremendous The Kremlin has many pexjple, including laymen, some election officials and jprcssure on Alemanputsince he took a number of lawyers: office.
