The lawsuit was filed in U.S.r District Court Thursday by J. and M. Anderson on behalf of E. Anderson, a high school student in the Jordan School District. Brian Barnard, the attorney representing the family, said his clients asked that only their first initials be used. The lawsuitargues that the law doesn't give school leaders discretion in such disciplinary matters, which is required by federal law. Barnard said the law jeopardizes $38- million in federal funds for Utah schools and would irreparably harm the student plaintiff's right to a public education. '"There's a state constitutional right to a free public education. If $38 million is cut out of our school budget, our schools are going to grind to a halt," Barnard said. Gov. Mike Leavitt and Utah Attorney General Jan Graham are named as defendants. Graham's office had not seen the lawsuit and therefore would not comment on it Thursday afternoon. Leavitt spokeswoman Vicki Varela said the governor's office also hadn't seen the suit. "But without knowing all of the (suit's) details, we can say that Gov. Leavitt stands fully prepared to back a principal who kicks a kid out of school for bringing a gun. Guns have no place in our schools, and kids have no reasons to bring them there." The lawsuit seeks to stop the law from taking effect April 30. It asks for a temporary injunction on the bill's implementation until the case can be resolved. The lawsuit also seeks attorneys' fees and other relief as the court sees fit: The student plaintiff has not been in trouble with safe schools laws, Barnard said. The lawsuit states the federal Gun Free Schools Act of 1994 requires that Utah public schools give superintendents discretion as to appropriate discipline for students bringing weapons onto school property. Its advocates contend it improves mental efficiency Iron County Attorney Scott Burns said the surgery took place Jan. 22 at a Beryl home and was filmed by a television crew, for ABC's "2020." The show aired Feb. 10. Peter Evan Halvorson, 43, and William E. Lyons, 45, are charged with a third-degre- e felony punishable by up to five years in prison. Neither man has been picked up by police, but warrants have been issued for their arrests. Attempts by The Associated Press to contact the men Thursday were unsuccessful. No phone number could be found for Halverson, and Lyons has an unlisted number. Area residents saw the program on TV and recognized the men, Burns said. A probable cause statement alleges Halvorson and Lyons partially drilled a hole in the an English woman, head Heather Evelyn Perry, 29. The video showed a patch of hair being shaved and the woman then injecting herself with local anesthetic. An incision was made, Halvorson allegedly spread the incised skin and exposed Perry's skull cap and Lyon allegedly then used a metal instrument to drill a hole in Perry's skull. Before the surgery could be finished, they were interrupted by a Beryl man whose brother owned the home and the group left. The trepanation reportedly was completed somewhere; else. jf '.HfcW?'
