Bakke that said schools could use affirmative action to achieve a diverse student body and correct past incidences of discrimination According to the Appeals Court decision, using race as a criteria for admissions, "treats minorities as a group rather than individuals." "The Hopwood decision has serious implications for Texas, including the virtual resegregation of higher education," said Robert Berdahl, president of the University of Texas at Austin. Two weeks ago, a three-judg- e panel of the fifth Circuit Court of Appeals, in the case of Hopwood v. Texas, ruled that preferential treatment for minority applicants was unconstitutional in undergraduate and graduate programs since it implicitly discriminated against more qualified white, male applicants. The court ruling abandoned the and the two other states, Louisiana and Oklahoma, that fall into the Fifth Circuit's jurisdiction. The University of Utah will continue their admissions procedures as normal, but administrators arc mindful of the changing attitudes toward affirmative action. "I think affirmative action is under serious attack. I think we need to be firm on our stance." said Linda Amos, chairwoman of the Presidential Commission on the Status of Women at the U. It is possible, and some would say likely, that an appeal to the Hopwood decision could end up in the Supreme Court in the next year and provide a definitive ruling on the constitutionality of affirmative action policies, and nobody is sure what the outcome of that case would be. Stayner Landward, director of admissions at the U, defends the current affirmative action policy. "If there arc undcrreprcsented populations on this campus and wc help rectify and balance their representation, wc need to do that. "It's important for admissions officers around the country to be sensitive to undcrreprcsented populations," he said, adding that the fundamental principle for admissions officers is, "to admit people who arc likely to succeed."
